AN 'ORDINANCE AMENDING ORDINANCE NO. 6871, THE
COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF
MIAMI, BY AMENDING ARTICLE XXIII, OFF-STREET
PARKING AND LOADING, BY REVISING SECTION 2, SUB-
SECTION i 2) TO CHANGE THE MAXIMUM PERCENTAGE OF
REQUIRED PARKING SPACES ALLOWED POR COMPACT CARS,
AND BY ADDING NEW SUB -SECTIONS (2A) AND (2B) TO
SECTION 4'TO ESTABLISH MINIMUM OFF-STREET PARK-
ING SPACE REQUIREMENTS POR HOUSING FOR LOW-INCOME
FAMILIES AND INDIVIDUALS AND HOUSING POR THE
ELDERLY; REPEALING ALL ORDINANCES, CODE SECTIONS
OR PARTS THEREOF IN CONFLICT INSOFAR AS THEY ARE
IN CONFLICT; AND CONTAINING A :SEVERAfILITY PRO-
VISION.
WHEREAS., the Miami planning Advisory Board, at its meeting
of February 9, 1977, Item #1, following an advertised hearing,
adopted Resolution No. PAB 9-77 by a 7 to 0 vote recommending
amendment to the Comprehensive Zoning Ordinance No. 6871, ARTICLE
XXIII, OFF-STREET PARKING AND LOADING, by revising Section 2,
Sub -section (2), and by adding new Sub -sections (2A) and (28) to
Section 4, as hereinafter set forth: and
WHEREAS, the Commission deems it advisable and in the best
interest of the City of Miami and its inhabitants to amend said
Ordinance, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance of the city of Miami be, and the same is hereby amended
by revising Section 2, Sub -section (2) as follows (changes under-
lined) ;
(2) Each parking space required or provided shall not be less
than the followings (ORD. 8343)
(a) 90° angle parking: Nine (9) feet in width and twenty
(20) feet in length except that thirty (30) percent of the
spaces may be seven and one-half (7 1/2) feet in width and
seventeen (17) feet in length and shall be clearly designated
for "compact only„ vehicles.
(b) 60° angle parking or less; Nine (9) feet in width and
twenty (20) feet in length except that thirty (30) ercent
of the spaces may be seven and one-halfU171721 e

Each parking apace shall be accessible from a street or
ally from an adequate aisle or driveway leading to a street
or alley without driving through any other parking space.
Access aisles shall be a minimum of twenty-three (23) feet for
90° angle parking., sixteen (16) feet and eight inches for 60°
angle parking, ten (10) feet and ten (10) inches for 4S° angle
parking, and ten (10) feet and four (4) inches for 30° angle
parking. Except for lots fifty (50) feet or less in width, drive-
ways leading to parking areas shall have no less than eight (8)
feet of paved width with no projections into the driveway area
for a height of seven (7) feet, and shall be a minimum of three
(3) feet from any building or structure, and a minimum of two
(2) feet from any property line (ORD. 8320). On lots having a
width of fifty (50) feet or less, driveways leading to parking
areas shall have no less than eight (8) feet of paved width with
no projections into the driveway area for height of seven (7)
feet, and shall be a minimum of twenty (20) inches from any
building or structure and a minimum of two (2) feet from any
property line. The aforementioned areas of separation for the
driveway shall be appropriately landscaped. (ORD. 8320).
Where it crosses the base building line, a driveway shall
be a minimum of five (5) feet from any side property line and a
minimum of nine (9) feet in width. When parking spaces are
located within the first twenty (20) feet of the front yard, as
measured from the base building line and laid out approximately
parallel with the base building line, a driveway that also serves
as access aisle shall be a minimum of eighteen (18) feet in width
where it crosses the base building line for buildings containing
three (3) or more dwelling units. (ORD. 8320).
No door or pedestrian entrance at ground level shall open
directly upon any driveway or access aisle unless the doorway
or pedestrian entrance is at least three (3) feet from said
driveway or access aisle. (ORD. 8320).

Section 2. Ordinance No. 6871, the Comprehensive Zoning
ordinance of the City of Miami be, and the same is hereby amended
by amending ARTICLE XXIII OFF STREET PARKING AND LOADING,
Section 4, by adding new Sub -sections (2A) and (28) as follows:
Section 4 - AMOUNT OF OFF-STREET PARKING
The off-street parking required by this Article shall be provided
and maintained on the basis of the following minimum requirements;
(2A) HOUSING FOR LOW-INCOME FAMILIES AND INDIVIDUALS - 1.5 park-
ing for each dwelling unit, however 0.5 spaces per dwelling
unit may be set aside and maintained as open space, either
in recreational use and/or- landscaping, until such area may
be converted to additional off-street parking at the
discretion of the City.
(28) HOUSING FOR THE ELDERLY - 0.30 parking spaces for each
dwelling unit.

Section 31 All Ordinances, code sections, or parts
thereof in conflict herewith, insofar as they are in conflict,
are hereby repealed.
Section 4. Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid,
the same shall not affect the validity of the Ordinance as a
whole

Consideration of amending the Comprehensive Zoning

AND LOADING by revising Section 2, sub=section (2) to
change the maximum percentage of required parking spaces
allowed for compact cars, and by adding new sub=sections
(2A) and (213) to Section 4 to establish minimum off&street
parking space requirements for housing for Low.Income
1!"amilies and Individuals and linusing for the Elderly.
To increase allowable off-street parking spaces for compact
cars from 25% to 30°0l to reduce the off-street parking
requirements for 1-lousing for Low Income Families and
dousing for the Elderly.
Since the last similar revision of the Ordinance in 1974,
there has been a continuation of the trend towards small
car production and ownership, as evidenced by the following
items:
1. In Dade County it is estimated that well. over 40% of
all registered automobiles met the dimensional
requirements for utilization of the cornpact parking
stall (1974).
L. National trends indicate that in the first half of 1976
sub -compact, compact, and luxury small automobiles
composed 46% of the auto market, a 4% increase from
1974 and a 13% from 1973.
3. Projected future trends according to expel l.s from the
automobile industry foresee a move towards function-
alism and downsizing.
4. There is an increase in the availability of small size
cars. In 1974 they composed 44% of the models sur-
veyed by Consumer Reports while in 1976 they repro-
sented 61% of the models.
5. Increasing automobile cost, maintenance and operation
support the growth in numbers of the generally less
expensive smaller size automobiles.
Federal requirements call for improved auto efficiency
which can only be met currently through lighter and
smaller vehicles,

Mousing developments for the elderly and low.incorne
family typically do not generate the same parking demands
as do conventional housing developments. Developers of elderly
and low incotne housing must now apply for A parking variant,
before the Zoning Board, which both the Manning Departtrient
and Zoning Board have viewed syn- patheticalty. Therefore
to shorten the tithe required for developers to secure building
permits for these projects and to eliminate unnecessary
public hearings, off street parking requirements for elderly
and low.incottte housing development could be processed
ackninistratively,
During the last few years, through the variance procedures
(above) an average of 0.5 parking spaces per unit has been
provided for publicly subsidized housing for the elderly.
According to Dade County Depar trnent of Housing and Urban
Development this is far in excess of existing utilization which
runs at approxirnately fifty percent (5O%), resulting in an
actual utilization rate of .25 spaces per unit,
tt has also been the experience of Dade County Department
of Housing and Urban Development that 1.5 parking spaces
per unit for publicly subsidized housing for low-income
families is more than adequate for tenant and guest parking.
Approval, an increase in the allowable percentage of parking
spaces designated for compact automobiles from 25% to 30%
is recommended. To recognize the particular needs for
off-street parking spaces for Housing for Low Income Fatnili...s
and Individuals and Housing for the Elderly, a reduction in
off-street parking requirements is recommended.
Approval by PAB 33-76 by 5-0 vote (2 absent) at December 1,
1976, meeting.
The Law Department determined that certain language in
the existing ordinance was inadvertently omitted by the
Planning Department and has recommended reconsideration
of a corrected text by the Planning Advisory Board.
