A RESOUTION AUTHORI7INO AND DIRECTING THE
FINANCE DIRECTOR TO PAY A TOTAL OP $8,200,00
PROM THE PARRS F`OR PEOPLE BOND PUND8 POR
ATTORNEY'S PEES AND COSTS POR PARCEL NO.
7091-3 IN THE CASE OP CITY OP MIAMI V, PLATO
COX, ET AL,. CIVIL ACTION NO. 74=4125, IN
ACCORDANCE W1TH THE ORDER OP COURT.
WHEREAS, the City of Miami filed an Eminent Domain
proceeding styled City of Miami v. Plato Cox, et al, Civil Action
No, 74-4125, in an attempt to take the property necessary for the
Latin Riverfront Park; and
WHEREAS, notwithstanding the fact that the court deter-
mined that the City had failed to prove public need and necessity,
the City is nevertheless required to pay all costs and attorney's
fees reasonably incurred in defense of the action; and
WHEREAS, Ribas Commercial, Inc. and Riverside Boat
t 1 u5Service, Inc., who were tenants on Parcel No. 7091-3, incurred

WHEREAS, the court ordered the City to pay said sums
to the attorney, Arthur F. McCormick and the appraiser, John J.
Dinda respectively;
NOW, THEREFORE, BE IT RESOLVED BY THE'4-COMMISSION OF THE

Section 1. The Finance Director be, and he ls hereby
authorized and directed to pay the sum of $7,500.00 to Arthur F.
McCormick and the sum of $700.00 to John J. Dinda, from the Parks
for People Bond Funds for attorney's fees and costs respectively,
for Parcel No. 7091-3 in the case of City of Miami v, Plato Cox,
et al.., Civil Action No. 74-4125, in accordance with the court
order.

Attorhey's fees and Costs
City of Miami v. Plato Colt, et al
(Latin Riverfront Park)
The Circuit Court awarded attotnev's fees and costs in the amount
of $8,200.00 to the tenants of Parcel No. 7091-5 in the above
styled cause.
This concludes all of the costs and expenses which were incurred
as a result of the attempted taking in the above styled cause.
