WHEREAS, the City duly advertised for, received
and considered bids for the purchase of a new type of fire fight-
ing breathing apparatus; and
WHEREAS, the City on January 13, 1977 rejected the only
two bids that were submitted on the basis of the facts enunciated
in Resolution No. 77-49, a copy of which is attached hereto; and
WHEREAS, an emergency situation now exists in that the
fire fighting breathing apparatus now in use is obsolete and in a
state of disrepair; and
WHEREAS, further delay in acquiring current fire fighting
breathing apparatus will vitally affect the life and health of the

BREATIHING APPARATUS AGREEMENT
TIIIS AGREEMENT made and entered into this day of
1977, by and between the CITY 0I"MIAMI, a municipal corporation organ-
iced and existing under the Laws of the State of Florida, hereinafter
referred to as "CITY", and Survivair, a division of U.S. Divers Company,
hereinafter referred to as SURVIVAIR:

H;EREAS, the CITY duly advertised for, received and considered
bids for the purchase of a new type of fire fighting breathing appara-
tus; and
WHEREAS, the CITY rejected the only two bids that were submitted
on the basis of the facts enumciated in Resolution No. 77-49; and

for the protection of the citizens of the CITY and the safety of the
CITY'S fire fighters; and
„HERE,.s, SURVIVAIR can provide the CITY with immediate
use of the current type fire f i;,htin breathing apparatus until it can
have the new type available;
NOW, THEREFORE, in consideration of the mutual covenants and
agreements hereinafter set forth, the CITY and SURVIVAIR hereby agree
as follows:
1. SURVIVAIR agrees to supply to the CITY, in multiples of
50 units, Survivair part ;,9S33-22 (a 30-minute Pressure Demand breathing
apparatus with a silicone facepiece; not including a carrying case)
for an ( greed price of 8540.00 per unit. If notified before March 31,
1977, SURVIVAIR will guarantee delivery of the above described breathing
apparatus within approximately 30 days,

In order to be acceptable for trade-in the units must be
in usable condition.

In the event of termination of this agreement, any advance

Factory training in normal maintenance and repair wi11 be
provided by SURVIVAIR.
2. During the two-year period from 1977 to 1979, comrnencin
with the date of delivery in 1977, SURVIVAIR will accept from the
city one Survivair Part #9838-22 (a 30-minute Pressure Demand breathing
apparatus) as a trade-in toward each unit of SURVIVAIR'S NASA type
fire fighter's breathing system (a 30-minute pressure demand breathing
appaIra tus with a 4500 PSI capacity.)
Under the provisions

to a 107 discount from the list price of the NASA type unit at the
time of purchase.

Emergency Acquisition of
Breathing Apparatus
Survivair's Proposals
The obsolete design and the deteriorated condition of the Fire Depart-
ment's breathing apparatus presents a dangerous and hazardous situation
to the health and safety to our Fire Fighters. This equipment does not
meet the recommendations of the National Institute for Occupational
Safety and Health (NIOSH) for positive pressure performance capabilities.
In 1976, we experienced some leakage problems as a result of the poorly
fitted replacement parts sold to us by Mine Safety Appliances Company
(NSA), causing smoke inhalation to three of our Fire Fighters. Subsequently,
in a memorandum dated April 23, 1976, the previous City Attorney, Mr. John
Lloyd, stated that he could no longer consider Mine Safety Appliances Co,
a responsible bidder. To add to this problem, NIOSH will not approve the
replacement parts of one manufacturer to be placed on the equipment of an-
other manufacturer.
For your information, there are only three major manufacturers of breathing
apparatus in the United States:
1. Mlle Safety Appliances Cemp:Inv
The legal opinion of April 23, 1976 prohibits us from dealing
with this company.
2. Scott Aviation (A Division of A-T-O, Inc.)
This company is the sole manufacturer of light -weight, NASA-
type breathing apparatus and Biscayne Fire Equipment Company
is the sole distributor in our area.
On December 2, 1976, we received two bid proposals on breath-
ing ;apparatus from these two vendors. Those proposals were
identical and considerably higher than the prices quoted to
other cities. Subsequently, upon my recommendation and that
of the Purchasing Agent, the City Commission rejected the
bids on January 13, 1977.
3. Sur.viv;air (Division of U.S. Divers Company)
This company is presently tooling up for production of their
version of the NASA -type breathing, apparatus which they anti-
cipate will be on the market within eight to ten months. We
feel that it would be to our advantage to invite bid pro-
posals at that time when there will be a more competitive
market.

In the interim) we have no replacement parts for existing units and we
anticipate the possibility of potting breathing apparatus out of set.,
Vice within the next few weeks.
We have met with the manufacturerts representative of Survivair with
respect to the availability of their conventional breathing apparatus
and their proposal is herein attached. Survivair will furnish us with
the use of 150 new 4IOSH-approved) conventional -type breathing ap-
paratus at a fee which is most acceptable to our department.
The recent paint fire explosion and the little Iiavana fire also caused
severe damage to breathing units for which no replacement parts are
available, The situation is serious now and will become an emergency
situation within the next few weeks, resulting in sire Fighters being
without respiratory protection when called up to fight fires. It is re-
quested that you consider approving an emergency acquisition of breathing
apparatus.
