SERVING TO THE CITY OF MIAMI THE RIGHT TO USE

WHEREAS, Dade County and the State of Florida are in the
process of acquiring right-of-way for the itprovement of S.W.
22 Avenue from U.S. 1 to West Flagler Street; and
WHEREAS, the City of Miami has been requested to quit claim
to Dade County all the public right-of-way previously acquired,
for this improvement; and
WHEREAS, it is deemed to be in the best interest of the City
of Miami to relinquish the aforesaid right-of-way to Dade County,
reserving, however, to the City of Miami the right to use same
for utility purposes, if necessary; and
WHEREAS, it is now in order for the City Commission to ap-
prove the conveyance of the aforesaid right-of-way to Dade County;
NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY

Section 1, The City Manager and the City Clerk of the City
of Miami are hereby authorized to execute and deliver to Metro-
politan Dade County, Florida, a quit claim deed for highway im-
provement all the public right-of-way previously acquired by the
City of Miami on S.W. 22 Avenue, from U.S. 1 to West Flagler
Street, Miami, Florida, more particularly described as follows,

Resolution Granting Deed to Dade
County for City of Miami Right..
of4Way Along S,W, 22 Avenue
Dade County and the State of Florida Department of Transportation
are in the process of acquiring the necessary right. -of -way for the
improvement of S.W. 22 Avenue from U,S. 1 to West rlagler Street.
Since the City of Miami has previously acquired certain right-of-way
all along S.W. 22 Avenue, we have been requested to quit claim all
our interest thereof to Dade County.
We have been advised by the City Attorney that the City of Miami may
quit claim its interest to the aforesaid right-of-way, but that
certain ,easements for the maintenance of public utilities should be
retained. Accordingly, the quit claim deed (copy attached) provides
for this reservation and is further made subject to existing cove-
nants, agreements, easements, restrictions, zoning ordinances, res-
ervations and limitations of record, if any.
It is now in order for the City Commission to agree to the granting
of a quit claim deed to Dade County for aforesaid right-of-way.
THE DEPARTMENT OF PUBLIC WORKS RECOMMENDS ADOPTION OF THE ATTACHED
RESOLUTION CONVEYING TO DADE COUNTY ALL PREVIOUSLY ACQUIRED RIGHT-
OF-WAY ON S.W. 22 AVENUE FROM U.S. 1 TO WEST FLAGLER STREET; AND
AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE
A QUIT CLAIM DEED THEREFOR.
