ORDINANCE NO, 8128
AN ORbINANCE AMENDING ORDINANCE NO. 6871, THE
COMPREHENSIVE ZONING ORDINANCE 1 OR THE CITY CI'
MIAMI, BY APPLYING ARTICLE XXI-4, COCONUT GROVE
OVERLAY DIS''LR7CT 1SP1 -2) TO THE FOLLOWING AREAS
IN COCONUT GROVE: (a) ON BOTH SIDES OF S.W. 27TTH
AVENUE FROM SOUTH DIXIE HIGHWAY 'TO TIGERTAML AVENUE;
(b)THE SOUTH SIDE OF SOUTH DIXIE HIGHWAY PROM S.W.
22tND AVENUE TO S.W. 307E COURT; (c) THE SOUTH SIDE
OF TIGERTAIL AVENUE FROM 150' EAST OF AVIATION
STREET TO CORNELIA DRIVE; AND (8) SOUNDED BY DAY
AVENUE, VIRGINIA STREET, OAK AVENUE AND TI'GERTAIL
AVENUE, AS PER MAP ATTACHED HERETO AND MADE A PART
HEREOF; AND BY MAKING THE NECESSARY CHANGES IN THE
ZONING DISTRICT MAP MADE A PART OF THE SAID ORDI-
NANCE NO. 6871 BY REFERENCE AND 'DESCRIPTION IN
ARTICLE III, SECTION 2 THEREOF; BY REPEALING ALL
ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN
CONFLICT; AND CONTAINING A SEVERARILITY PROVISION.
WHEREAS, the Miami Planning Advisory $ward, at its meeting
of January 5, 1977, Item #3, following an advertised hearing*
adopted Resolution tto. PAD 1-77 by a 5 to 2 vote recommending
the application of the newly proposed ARTICLE XXI-4, COCONUT
GROVE; OVERLAY DISTRICT (SPD-2) to areas in Coconut Grove, as
hereinafter set forth; and
WHEREAS, the City Commission,, after careful consideration
and due deliberation of this matter, deems it advisable and in
the best interest of the City of Miami and its inhabitants to
grant said application;
NOW, THER 'ORE, BB IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMMI, FLORIDA:
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami be, and the same is hereby
amended by applying ARTICLE K?I-4, COCONUT GROVE OVERLAY DISTRICT
(SPP-2) to following areas in Coconut Grove: (a) on both sides
of 5.14. 27th Avenue from South Dixie I ighctiay to TigeItail Avenue;
(b) the south side of South Dixie Highway from S.W. 22nd Avenue
tQ S.W. 30th Curt; (c) the south aide of Ti.gertai.l Avenue from
15Q' oast of Aviation Street to Cornelia Dive; and (d) bounded
by my Avenue, Virginia Street, Qah Avenue and Tictertail Avenue,

ag per map attached hereto and made a part hereof; and by
making the necessary changes in the 2oning District Map made a
part of the said Ordinance No. 6A71 by reference and descriptiOn
in Article ItI, Section 2 thereof.
Section 2. All laws or parts of laws in conflict herewith
be, and the same are hereby repealed insofar as they are in
conflict.
Section 3. Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid
the same shall not affect the validity of the ordinance as a
whole.

Reconsideration of the Application of the proposed .ARTICLE
XXI-4 COCONUT GROVE OVERLAY DISTRICT (SPb-2) to
those areas in Coconut Grove generally a) on both sides of SW
27th Avenue frotn South Dixie llighway to Tigertail Avenue; b)
the south side of South Dixie Highway from SW 22nd Avenue to
SW 30th Court; c) the south side of Tigertail Avenue from 150' east of
Aviation Street to Cornelia Drive and d) bounded by Day Avenue,
Virginia Street, Oak Avenue and Tigertail Avenue.
EXPLANATION The consideration of this district was first Beard in 1975 when
controversy over the application of height controls to lie►yshare
Drive caused the Commission to indefinitely defer the second
reading pending an economic study by objectors to the ordinance's
effect. Subsequent meetings of the Department., Coconut Grove
civic: organizations and affected property owners have not resolved
the liaysliure Drive issue. It is therefore recommended in the
interest of expediting coverage of non -controversial areas that
application of the SP1)-2 be made to all original areas of applica-
tion except the Bayshore !)rive area which will be scheduled later.
