HomeMy WebLinkAboutO-08627flRBINANCE NO. 8627 AN ORDINANCE AMENDING ORDINANCE NO. 6971, THE COuPRE- HENStVE ZONING ORDINANCE POR THE CITY OP MIAMI, BY INSERTING A NEW ARTICLE XXI-4, COCONUT GROVE OVERLAY DIET ttCT (StD4) D PROVtlllNG rota INTENT EPF CT Or THE SPECIAL OVERLAY DISTRICT, BITE AND DEVEL•PIIE T PLAN REVIEWS ,AND HEIGMT; REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONI±'LICT tNSO1'AR AS THEY ARE IN CON1"tatCT; AND CONTAINING A SEVERAt3ILITY PRO- VISION, WHEREAS, the Miami Planning Advisory Roard, at; its' meeting of December 8, 1976, Item #3, following an advertised hearing, adopted Resolution No. PAfl 37-76 by a 5 to 0 vote (3 members absent) recommending an amendment to the Comprehensive Zoning Ordinance No. 6871, by inserting a new ARTICLE XX7-4, COCONUT GROVE OVERLAY DISTRICT (SPD-2), as hereinafter set forth; and WHEREAS, the Commission deems it advisable and in the best interest of the City of Miami and its inhabitants to amend said Ordinance, as hereinafter set forth; NOW, THEREFORE, DE IT ORDAINED BY THE COMMISSION OP THE CITY or MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance of the City of Miami be, and the same is hereby amended by inserting a new ARTICLE XXI-4, COCONUT GROVE OVERLAY DISTRICT (SPD-2) as follows: ARTICLE XXI-4 SPD-2-COCONUT GROVE -SPECIAL OVERLAY DISTRICT Section 1. - INTENT (1) The Village of Coconut Grove is possessed of a unique, cultural and historic heritage and a distinct physical identity embodied in the diver- sity and abundance of plant material .and the limited scalp of private development and public ways. It is therefore in the public interest that future public and private development respect and enhance the character of Coconut Grove's physical environment, thereby preserving its property values and enhanc- ing its desirability as a place to live and work. It is the intent of these regulations to preserve and enhance the elements of its community character particularly as they relate to those areas that aro highly visible, intensely developed and strategi- cally located along major entrances to the community. It is farther intended that these regulations pro- tect against discordant or incongruent design and encourage development which lead to the con- servation and improvement of the community in a manner appropriate to the preservation of its unique physical, cultural and historic heritage. Section 2. - EPPECT Oy TR SPECIAL OVP.RtAY bISTt ICT (1) Thin district is superimposed over existing Zoning districts and modifies these moiling d.e- tricts to the extent indicated by the regulations set forth herein. (2) This district shall be identified in the Compre- hennive Zoning Atlas by the prefix SPD-2 encom- passing existing 2©ning diat:ricts. (3) All other 2tning regulations and procedures not affected by this regulation shall be in full force and effect. Section 3. - SITE AND DEVELOPMENT PLAN REVIEWS (1) All new development, redevelopment, remodeling or improvement, and/or additions to existing sites or structures within the District shall be subject to site and development plan review by the Planning Department in accord with Article IV, Section 42. (a) Design Review Standards - the following standards shall be utilized in reviewing all site, building and development plans. They are intended to pro- vide a frame of reference for the applicant in the development of site and building plans and are not regarded as inflexible requirements, nor are they intended to discourage creativity and innovation. 1. Relation of Proposed Buildings to Environment Proposed improvements shall be related harmoniously to the terrain and in particular protect and en- hance natural features such as rock outcroppings, grade changes and the Coastal Atlantic ridge. The relationship of new structures to surrounding buildings shall be sympathetic with regard to form, size, spacing and visual character. The design of new development shall be cognizant of Coconut Grove's limited but distinct architectural heritage that spans the extremes of modest wood frame settlers' homes to Italian Renaissance estates and includes Bahamian, Conch, Spanish and Mediterranean architectural styles. The use of building materials and colors should be compatible with surrounding development and in particular, landscaping. 2. Landscaping, Screening and Open Space. The landscape ,shall be preserved in itu natural state, insofar as practicable, by minimizing tree and soil. removal.. Landscape standards for off-street parking, yard areas and open space requirements established by this ordinance shall be considered as supplemental to retention of the natural features of the site. Site design shall consider the place- ment of buildings on the property to achieve maxi- mum retention of existing landscaping and open space as well as adequate provisions of new compatible landscaping. The use of native plant material- is to be encouraged whenever possible in landscape plant eeiection. All accessory areas & structurea sueh as service and leading areas shall be adequately nereened by piantingn or other screening methods to achieve proper visual relatiennhips with surrounding properties. Driven , parkin and Circul n sand tili i_ a Spacial attention shall be given to location and number of access points to the public streets, internal and external traffic and circulation, separation of pedestrian and vehicular traffic, and arrangement of parking areas that are safe and convenient. Where possible all utilities shall be underground with attention given to services and servicing of utilities. Section 4. - HEIGHT (1) Within this district, no structure located in the following z oning districts shall be erected or altered to exceed a height as specified for that zoning district: R-4 - four (4) stories or forty (40) feet C-2 - four (4) stories or forty (40) feet, Section 2. All ordinances, code sections, or parts thereof in conflict herewith, insofar as they are in conflict, are hereby repealed. Section 3. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. 'Ihe SPI)-2 overlay ordinance provides for a four story height limit and site plan review to be added to the regulations of all existing zoning districts within the area of applications The use of the overlay district precludes the necessity of rewriting all the zoning districts within these areas to include these two regulations. '1he application of this ordinance is rased on two objectives set forth in the Planning Study for Coconut Grove: 1) 'I he control of development height in high intensity resi- dential and commercial districts to preserve the scale and character of Coconut Grove, and the requirement for site and development plan review and approval by the planning Department of all high intensity residential and commercial development. I ltruugh zoning changes, these objectives have been accomplished in the Douglas Road, Grand Avenue, laird Road, and Village Center shopping area. As zoning changes are riot considered desirable fur the 27th Avenue and Dixie highway areas, the overlay district is a means o1 acculnpllshitlg these desired objectives for those area:: APPROVAL, Recommended approval, Resolution N:37-7o, December 8, 1976, by a 5-0 vote, 2 members absent. Seven return notices in favor, and three return notices opposing the proposal were received. One aftect&•ci property owner objected t„ !he height restraints of the proposal. Approved on first reading February 2.3, 1977.
