HomeMy WebLinkAboutO-086262F3/77 ORDINANCE NO, AN ORDINANCE AMENDING ORDINANCE NO, 8871 THE COMPREHENSIVE EONIN0 ORDINANCE FOR THE CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFhCAT1ON OF THE WEST 10' OF LOT B, BLOCK 2, MOTTL PARK (3940) AND THE WEST 20' OF LOT 11, W.D, SANFORD'S SUB (4-28) BEING EAST OF 2665 S.W. 37TH AVENUE, FROM R-2 (TWO FAMILY) TO C-2 (COMMUNITY COMMERCIAL); AND BY MAKING THE NECESSARY CHANGES IN TIME ZONING DISTRICT NAP MADE A PART OF THE SAID ORDINANCE NO. 6871 BY REFERENCE: AND DESCRIPTION IN ARTICLE Itt, SECTION 2 THEREOF; BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY PROVISION, WHEREAS, the Miami Zoning Board at its meeting of January 17, 1977, Item Nos 2, following an advertised Bearing, adopted Resolution No, P8 13-77 by a 7 to 0 vote recommending change of zoning classification as hereinafter set forh; and WHEREAS, the City Commission, after careful consider- ation and due deliberation of this matter, deems it advisable and in the best interests of the City of Miami and its inhabitants to grant said petition; NOW, THEREFORE, BE IT ORDAINED BY TPE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance for the City of Miami be, and the same is hereby amended by changing the zoning classification of the West 10' of LA 6, Block 2, Mottl Park (39-60) and the West 20' of Lot 11, W.D. Sanford's Sub (4-26), being East of 2665 S.W. 37th Avenue, from R-2 (Two Family) to C-2 (Community Commercial); and by making the necessary changes in the Zoning District Map made a part of the said Ordinance No. 6871 by reference and description in Article III, Section 2 thereof, Section 2. That all laws or parts of laws in conflict herewith be, and the same are hereby repealed insofar as they are in conflict, Sect .on 3, Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the ordinance as a whole. A small portion of the existing structure encroaches into the abutting 1t-2 zoning district and the alignment of the proposed addition with the existing structure would likewise encroach into the It-2 zoning district, necessitating the requested zoning change. This item was deferred by the Board in December 1975 at the ,joint request of the applicant and the Planning Department in order to work out an appropriate solution. The change of zoning as recommended would accommodate the addition as proposed\vhile providing a r,rininrutn extension of the commercial zoning into the residential area. The applicant is aware that the existing parking areas must be improved to current standards and that the Planning Department will provide site plan review and approval. Parking requirements will be met through previously approved conditional use parking sates. Recommended approval for the west 10 feet of lot 6, Block 2 and the west 20 feet of lot 11 by Resolution Nl.13 13-77, January 17, 1977, by a 7-0 vote.
