AN ORDINANCE AMENDING ORDNANCE NO, 6871, THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OP
HIAMI, BY ADDING A NEW SUBSECTION (5) TO SECTION 44,
ARTICLE IV GENERAL PROVISIONS, TO PROVIDE THAT NO
REGULATED USE SHALL RESUME OPERATION, ONCE DISCON-
TINUED OR ABANDONED, UNTIL IT MEETS THE PROVISIONS
OF SECTION 44 AND OTHER APPLICABLE; REGULATIONS OP
THE ZONING ORDINANCE; REPEALING ALL ORDINANCES,
CODE SECTIONS, OR PARTS THEREOF IN CONFLICT; AND
CONTAINING A SEVERABILITY PROVISION.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of February 16, 1977, Item #5, following an advertised Hearing, adopted
Resolution No. PAB 17-77 by a 7 to 0 vote recommending an amendment to
Ordinance 6871, by adding a new Sub -section (5) to Section 44, ARTICLE
IV -GENERAL PROVISIONS, as hereinafter set forth; and
WHEREAS, the Commission deems it advisable in the best
interest of the inhabitadts of the City of Miami to amend said
ordinance as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI , FLORIDA:
Section 1.Ordinance No. 6871, the Comprehensive Zoning
Ordinance of the City of Miami be, and the same is hereby amended
by adding a new Sub -section (5) to Section 44, ARTICLE IV GENERAL
PROVISIONS, to -read as follows:
(5) Notwithstanding other provisions of this
ordinance, no regulated use shall resume
operation once it has been discontinued
or abandoned unless and until it meets
all the provisions of this section.
Section 2. That all laws or parts of laws in conflict
herewith be, and the same are hereby repealed insofar as they are
in conflict.
Section 3.Should any part or provision of this ordinance
be declared by a court of competent jurisdiction to be invalid, the
same ehall not affect the validity of the ordinance as a whole.
