HomeMy WebLinkAboutItem #10 - First Reading OrdinanceWEA/ts 3/4/17 ORDINANCE NO, AN ORDINANCE AMENDING ORDINANCE NO, 6871, THE COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OP MIAMI, BY AMENDING ARTICLE XXIII, OPP-STREET PARR/NG AND LOADING, BY REVISING SECTION 2, SUB- SECTION (2) TO CHANGE THE MAXIMUM PERCENTAGE OF REQUIRED PARKING SPACES ALLOWED POR COMPACT CARS, AND BY ADDING NEW SUB -SECTIONS (2A) AND (2B) TO SECT/ON 4 To ESTABLISH MINIMUM OFP-STREtT PARK- ING SPACE REQUIREMENTS FOR HOUSING FOR LOW-INCOME FAMILIES AND INDIVIDUALS AND HOUSING FOR THE ELDERLY; REPEALING ALL ORDINANCES, CODE SECTIONS OR PARTS THEREOF IN CONFLICT INSOFAR AS THEY ARE IN CONFLICT; AND CONTAINING A SEVERABILITY PRO- VISION, WHEREAS, the Miami Planning Advisory Board, at its meeting of February 9, 1977,.Item #1, following an advertised hearing, adopted Resolution No. PAB 9-77 by a 7 to 0 vote recommending amendment to the Comprehensive Zoning Ordinance No. 6871, ARTICLE XXIII, OFF-STREET PARKING AND LOADING, by revising Section 2, Sub -section (2), and by adding new Sub -sections (2A) and (2B) to Section 4, as hereinafter set forth; and WHEREAS, the Commission deems it advisable and in the best interest of the City of Miami and its inhabitants to amend said Ordinance, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. Ordinance No. 6871, the Comprehensive Zoning Ordinance of the City of Miami be, and the same is hereby amended by revising Section 2, Sub -section (2) as follows (changes under- lined); (2) Each parking space required or provided shall not be less than the following; (ORD, 8343) (a) 90° angle parking; Nine (9) feet in width and twenty (20) feet in length except that thirty {30) percent of the spaces may be seven and one-half (7 1/2) feet ih width and seventeen (17) feet in length and shall be clearly designated for "compact only" vehicles, (b) 60° angle parking or lees; Nine (9) feet in width and twenty (20) feet in length except that thirty (30) percent of the spaces way be seven and one -half-(7 172)-feet'in width and seventeen (17) feet in length and Shall be clearly designated for "Compact only" vehicles, (c) Parallel parking: Nine (9) feet in width and twenty, five (25) feet in length except that thirty (30) pergent of the spaces may be seven and one-half (7 1/2) feet in width and twehty=two (22) feet in length, and shall be Clearly designated for "compact only" vehicles. Each parking space shah be accessible from a street or alley from an adequate aisle or driveway leading to a street or alley without driving through any other parking space. Access aisles shall be a minimum of twenty-three (23) feet for 90° angle parking, sixteen (16) feet and eight inches for 60° angle parking, ten (10) feet and ten (10) inches for 45° angle parking, and ten (10) feet and four (4) inches for 30° angle parking. Except for lots fifty (50) feet or less in width, drive ways leading to parking areas shall have no less than eight (8) feet of paved width with no projections into the driveway area for a height of seven (7) feet, and shall be a minimum of three (3) feet from any building or structure, and a minimum of two (2) feet from any property line (ORD. 8320). On lots having a width of fifty (50) feet or less, driveways leading to parking areas shall have no less than eight (8) feet of paved width with no projections into the driveway area for a height of seven (7) feet, and shall be a minimum of twenty (20) inches from any building or structure and a minimum of two (2) feet from any property line. The aforementioned areas of separation for the driveway shall be appropriately landscaped. (ORD. 8320). Where it crosses the base building line, a driveway shall be a minimum of five (5) feet from any side property line and a minimum of nine (9) feet in width. When parking spaces are located within the first twenty (20) feet of the front yard, as measured from the base building line and laid out approximately parallel with the base building line, a driveway that also serves as access aisle shall be a minimum of eighteen (18) feet in width where it crosses the base building line for buildings containing three (3) or more dwelling units. (ORD. 8320). No door or pedestrian entrance at ground level shall open directly upon any driveway or access aisle unless the doorway or pedestrian entrance is at least three (3) feet from said driveway or access aisle. (ORD. 8320) Section 2. Ordinance No. 6871, the Comprehensive Zoning Ordinance of the City of Miami be, and the same is hereby amended by amending ARTICLE XXIII - OFF STREET PARKING AND LOADING, Section 4, by adding new Sub -sections (2A) and (2B) as follows: Section 4 - AMOUNT OF OFF-STREET PARKING The off-street parking required by this Article shall be provided and maintained on the basis of the following minimum requirements; (2A) HOUSING FOR LOW-INCOME FAMILIES AND INDIVIDUALS 1.5 park- ing for each dwelling unit, however 0,5 spaces per dwelling unit may be set aside and maintained as open space, either in recreational use and/or landscaping, until such area may be converted to additional off-street parking at the discretion of the City. (213) HOUSING FOR THE ELDERLY - 0,30 parking spaces for each dwelling unit, Section 3. All ordinances, code sections, or parts thereof in conflict herewith, insofar as they are in cohflict are hereby repealed, Section 4. Should any part or provision of this ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a Whole.
