HomeMy WebLinkAboutO-08621ORDINAACE AN ORDINANCE AMENDING SECTION 39-43 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, WHICH RESTRICTS BICYCLING AND MOTORIZED CYCLING IN THE CITY OF MIAMI REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT HEREWITH; AND PROVIDING A SEVERABILITY PROVISION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Miami Code now provides the following in connection with the use of bicycles and related motorized vehicles in City parks: "Sec. 39-43. picy_cles, tricyclesmotor _bikes`► scooters....or_smiler ..vehicles. Bicycles, tricycles, motor bikes, scooters or similar vehicles are restricted to the paved roadways for cars, trucks and buses. They may be walked (with motors off) in grassy areas and along pedestrian walkways. They may park any place where they will not inconvenience others. (Ord.No. 7999, WHEREAS, the rights of the public are not well -protected by the above regulation in view of the harm and risk of injury by motorized vehicles to persons, the very young and the elderly, using the pedestrian walkways in City parks; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MAMI, FLORIDA: Section 1, Section 39-43 of the Code of the City of Miami, Florida, as amended, which restricts bicycling and motorized cycling in the parks, is hereby amended in its entirety to read as follows: "Sec. 39-43. Bicycles, tricycles, motor bikes, scooters or similar vehicles. (a) Bicycles and tricycles are restricted to designated bicycle paths, but may ridden in other areas upon approval of the Department of Parks and Recreation. (b) Motorcycles, motorbikes, scooters or similar motorized vehicles are restricted to the paved roadways for cars, trucks and buses. tc) When the motors of vehicles in (b) above, are not operating, said vehicles, as welt as bicycles and tricycles, may be walked in grassy areas and along pedestrian walkways and may be parked any place where they will not inconvenience others." . Section 2. All ordinances, code sections or parts of ordinances, insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. It is now in order for the City Commission to authorize an Ordinance amending Ordinance #7999 as follows: "Bicycles and tricycles are restricted to designated bicycle paths, but may be ridden in other areas upon approval of the Department of Parks and Recreation. Motorcycles, motorbikes, scooters or similar motorized vehicles are restricted to the paved roadways for cars, trucks and buses. They may be walked (with motor off) in grassy areas and along pedestrian walkways. They may park any place where they will not inconvenience others."!
