A RESOLUTION AUTHORIZING THE DIRECTOR OP
FINANCE TO PAY TO LOURDES RODRIGUEZ AND
PERNANDO F. PREIRE, HER ATTORNEY, WITHOUT
THE ADMISSION OF LIABILITY, THE SUM OF
$7,447.57 IN FULL AND COMPLETE SETTLEMENT
OF ALL BODILY INJURY AND PROPERTY DAMAGE
CLAIMS AND DEMANDS AGAINST THE CITY OF
MIAMI, UPON THE EXECUTION OF A RELEASE,
RELEASING THE CITY Or MIAMI FROM ALL CLAIMS

WHEREAS, Lourdes Rodriguez, through her Attorney,
Fernando F. Freire, filed a claim against the City of Miami
for the alleged bodily injury and property damage claim against
the City of Miami, resulting from an accident involving a City
owned vehicle on April 22, 1976, at or near S.W. Third Street,
and S.W. 17th Avenue, Miami, Florida; and
WHEREAS, the above claim has been investigated by the
Torts Division of the City Attorney's office in accordance with
Ordinance 8417, which creates the City of Miami's Self -Insurance
Program, and said office recommends that these claims be settled
for $7,447.57;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the Director of Finance is hereby
authorized to pay to Lourdes Rodriguez and Fernando P. Freire,
her Attorney, without the admission of liability, the sum of
$7,447.57 in full and complete settlement of all bodily injury
and property damage claims against the City of Miami, uPQn the
execution of a release, releasing the City of Miami from all
bodily in)ury and property damage Claims and demands,

Lourdes Rodriguez has filed a claim against the City of Miami
through her Attorney, Fernando P. Preire, involving bodily injury
and property damage to her automobile, resulting from an accident
involving a City of Miami Sanitation unit.
The claimant was uninsured at the time of this particular accident.
This accident occurred on April 22, 1976, at 9:04 A.M., at or near
S.W. Third Street and S.W. 17th Avenue, Miami, Florida.
The City unit is a crane which is operated from the rear seat.
The claimant unit was eastbound on S.W. Third Street, with the
crane behind it. Both were stopped. The crane operator looked
to the front, attempting to see over the cap, didn't see anything,
pulled forward, at which time the front of the crane made contact
with the rear of the claimant vehicle.
Liability is fully against the City operator.
Total medical expenses concerning Lourdes Rodriguez is $2,727.75.
Verified lost time and wage is in the amount of $677.96. Total
special damages is $3,405.71.
The repair of the claimant vehicle, a 1973 Ford, is in the amount
of $447.57.
The above claim has been investigated by the Torts Division of
the City Attorney's office and in accordance with Ordinance No. 8417,
which creates the City of Miami Self -Insurance Program, and said
office recorrmends that the said claims be settled for the total
amount of $7,447.57.
