Iri response to your request regarding the disparities between the City's
Urban Development Review board and the Environmental Preservation Review
Board, the following has been prepared for your Consideration.
Background.
-' Urban Development Review Board
On September 9, 1971, the City Commission enacted Resolution 42762 which
established an Urban Development Review Board (UDRB) consisting of five
members to be Comprised of two landscape architects, and three architects.
The UDRB is to review plans submitted by the Zoning. Board and evaluate
development proposals in accordance with certain defined standards, i.e.,
density, purpose and relationship of the proposed development to their
immediate surroundings and settings, landscape control and use, utilities,
drainage, street circulation, scale, open space, and other aspects essential
to achieving a more meaningful environment. The Zoning Ordinance specifically
charges the UD?B to review and make recommendations on applications for Planned
Area Development (PAD) and for intensity bonuses in the RC-1 and RC-6 districts.
The Board meets in response to individual applications at the tall of the
Planning Department.
Environmental Preservation Review Board
0n September 12, 1974, the Commission enacted Ordinance No. 8301 establishing
an Environmental Preservation Review Board (EPRB) consisting of five members
to be comprised of a landscape architect, a nurseryman, an architect, an
environmentalist, a lay person interested in the environment. The Board's
responsibilities are the maintenance of records identifying unique environ-
mental sites, the hearing of development applications within established
environmental preservation districts including scenic transportation corridors
and serving in a quasi-judicial capacity granting or denying tree removal and
development activities within established environmental preservation districts.
The enforcement responsibilities for the ordinance rests in the City 'Building
Department, Division of Environmental Preservation, which has two personnel
assigned to provide enforcement, plan checking, and Board administration in-
cluding the processing of all matters requiring a public hearing.

?he City has received two proposals from the Environmental Preservation Review
Board, The first recommendation dated November , 1976, acid signed by David
Scully, Chairman, recommends that the City of MiaEii Urban Development Review
Board be dissolved and that the Environmental Preservation Review Board be
increased to a seven member Board by the addition of one architect and one
landscape architect, the second recommendation in a letter dated November 9,
l-7 , and signed by David Scully, recommends that the Environmental Preserva'
tion Review Board review all projects that are required to apply to the Ehvir
Mental Preservation Review Board prior to the review of any other City Board,

The Environmental Preservation Review Board apparently feels that there is an
overlap in the area of responsibility covered by the two ordinances. 1 have
reviewed the ordinances and the recent work of the two Boards and do not concur
in this position, The Urban Development Review Board has an orientation which is
directed at the scale, mass and bulk of the project and its effect oh surrounding
areas, while the Environmental Preservation Review Board is concerned principally
with the impact of the project on the site and the natural features of the site.
There apparently is a conflict between the review of projects for planned area
development that fall within an environmental preservation district. The ordinance
establishing the Environmental Preservation Review Board is quite specific in stating
that "when the zoning regulations applying to a parcel designated as an environ-
mental preservation district, require review by the Urban Development Review
Board, that Body shall be responsible for reviewing applications for tree removal
and development activity on that parcel in lieu of the Environmental Preservation
Review Board. All actions by the Urban Development Review Board on these appli-
cations shall be consistent with the intent of this Chapter."
In the past the Urban Development Review Board has requested the assistance of the
Environmental Preservation Review Board where their responsibilities take the place
of the Environmental Preservation Review Board.
One area that does present a problem is the term of appointment for the Environ-
mental Preservation Review Board. All five members' term of office expire simul-
taneously, thus potentially causing a gap in continuity relating to environmental
review considerations.
Recommendations
It is the recommendation of this office that the current two board system be
maintained, that the Urban Development Review Board continue to seek guidance and
assistance from the Environmental Preservation Review Board when the Urban Develop-
ment Review Board is acting in place of the Environmental Preservation Review
Board, and that the ordinance establishing the Environmental Preservation Review
Board be amended to provide for overlapping terms of office of the members.

Review ioard expires i'ebruary 10, 1977. this recommendation should be
dornmunicated to the City Commission for their agenda of February 24th4
at which time they should consider an amendment to the Ordinance #a301
to provide overlapping terms of appointment to the Environmental Preserva-
tion Review Board.

Dear Mr. Reboso:
Due to your awareness of the need to have a represen-
tative of the Latin community in the Environmental Pre-
servation Review Board, I was appointedFebruary on February 1976
to serve as an alternate member. It has been a wonderful
experience and I have tried to do ny best at this posi-
tion.
My constant travel to projects in Central and South Am -e-
rica
has been making it very difficult to attend the
meetings as I Mould have desired. The projects for this
year 1977 will make it practically impossible for me to
render the kind of assistance and work that the position
requires. It is therefore, with deep regret, that I am
asking you to accept my resignation to the position of
alternate member of the Environmental Preservation Re-
view Board.
I wish to thank you for the opportunity offered me to
serve the community.
