PARTNERSHIP, ON NOVEMBER 24, 1976, FOR HIGHWAY
WIDENING, A FIVE (5) POOT STRIP OP LAND PROM A
PORTION OP LOT 1, BLOCK 6, EDWARD PENT HOMESTEAD
(A-45), A/K/A 3058 SHIPPING AVENUE; AND DIRECT-
INC THE PROPEL OFFICIAL OF THE CITY OP MIAMI TO
RECORD SAME IN THE PUBLIC RECORDS OD DADE COUNTS

WHEREAS, The City of Hiatt Zoning Board at its meeting of
November 15, 1976, adopted Resolution No. ZB 178-76 granting a
"conditional use" to Zenith Enterprises, a Limited Partnership,
to permit construction of a residential development of a planned
unit nature on portion of Lot 1, Block 6, EDWARD PENT HOMESTEAD
(A-45), being 3058 Shipping Avenue, subject to a 5-foot dedication
of right-of-way; and
WHEREAS, Zenith Enterprises, a Limited Partnership, is agree-
able to execute a Highway Right -of -Way Deed for dedication of the
required land; and
WHEREAS, Zenith Enterprises, a Limited Partnership, has exe-
cuted and delivered to The City of Miami a Highway Right -of -Way
Deed of dedication for the required land as hereinafter set forth;
and
WHEREAS, it is now in order for the City Commission to accept
the aforesaid deed and to have it recorded in the Public Records
of Dade County, Florida.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 16 The November 24, 1976, Highway 'Right=af=way Deed
executed by Zenith Enterprises, a timited Partnership, for a five
(5) foot strip of lend from a portion of tot 1, nook 6, EDWARtD PENT
HOMESTEAD (A-45), being 0.58 Shipping Avenue, conveyed for highway
widening purposes be, and the same is hereby, accepted for the
consideration heretofore expressed.
Section 2. The proper official of The City of Miami be, and
he is hereby, authorized and directed to record the aforesaid Deed
in the Public Records of Dade County, Florida.
PASSED AND ADOPTED this MTH _- day of MARCH._

Dedication from Zenith Enterprises
a Limited Partnership
As a condition of being permitted "conditional uses' as listed in Ordi-
nance No. 6871, Article VI, Section 1 (4-A)(a), to permit construction
of a residential development of a planned unit nature on portion of
Lot 1, Block 6, EDWARD PENT HOMESTEAD (A-45), a/k/a 3058 Shipping Ave-
nue, Zenith Enterprises, a Limited Partnership, was obliged to dedicate
5 feet of right-of-way along the southerly side of Shipping Avenue in
order to bring said avenue to its fully zoned width, as per plans on
file; zoned R-2 (two family) .
In response thereto, Zenith Enterprises, a Limited Partnership, has
executed and delivered to the City of Miami a Right -of -Way Deed for the
required 5-foot dedication.
It is now in order for the City Commission to accept the aforesaid
Highway Right -of -Way Deed and to have it recorded in the Public Records
of Dade County.

RESOLUTION ACCEPTING THE HIGHWAY RIGHT-OF-WAY DEED EXECUTED BY ZENITH

in consideration of the sum of One $1.00) Dollar and other good
and valuable considerations to it in hand paid by the party of
the second part, the receipt whereof is hereby acknowledged, has

of Lot 1, in Block 6, EDWARD PENT HOMESTEAD, thence
Easterly along Shipping Avenue a distance of 25 feet to
a point, with this as the Point of Beginning, thence
Easterly along Shipping Avenue a distance of 92 feet,
thence in a Southerly direction 125 feet, thence in a
Westerly direction 92 feet, thence in a Northerly di-
rection 125 feet to the Point of Beginning, the above
described property being a lot 92 feet front on Shipping
Avenue and having a depth of 125 feet.
