Frn loan Agenda of Februa.ty 24, 1977 Assistant o he City Mata.ger Attached are the recommendations by the Expanded Committee for Closing I -lours of Liquor F2stablishments. These recornmenda.tions, according to advice from the Law Department, cannot be considered final in that provision must be made for open public cornrnent on the Committee's proposals before they can be submitted to the Commission as Final Recommendations. I will work with Dr. Conrad Willard, Chairman of the Expanded Committee, and the City Clerk to arrange and publicize a final session of the Committee where general public con -in -lent can be solicited and heard. After that session, 1 will ask the Law Department to draft a proposed Ordinance reflecting the Committee's final recommendations, The February 24th Agenda item will involve simply the presentation to the Commission of an '•intcr:rn' set of recommendations. The Commission will then have an opportunity to clarify or add to its previous charges to the Expanded Committee. It is important to emphasize that NO action will be taken by the Commission at this meeting, Only after a final, publicized meeting of the Expanded Committee and after the resulting final recommendations wifl the Commission be requested to consider taking official action. The committee consists of Dr. Conrad R. Willard (chairman) , Tom Nesbitt, Rita Stone, Jades Stratos, Lt. X. Harrison and the undersigned, in addition to Mrs. I, Ricky Caminiti, Father John Edwards, David Pincher, Jerome RoTinson," Al Sakolsky, and Luis Sabines . Carrying out the will of the committee, I respectfully report to you and Commissioners Gordon, Plummer, Gibson and Reboso the following findings and recommendations: 1. There is attached hereto a chart entitled Hours for Sale of Alcoholic Beverages Proposed by Mayor Ferrets Committee (January of 1977)" which reflects the hours of closing which we recommend. 2. Bearing in mind the guidelines given to us by you and the commissioners, we have reconsidered that portion of our July 7th report which is designated (b-2) in paragraph 3 on page 2. We now feel that there should be no limitations on grocery stores outside the downtown zone; so that, we recovmend the hours of sale of beer and wine in that category to be: "While Store is Open". This applies seven days a week. 3. We feel that we have achieved uniformity between the various types of liquor establishments within the city, as nearly as is feasible, by recommending that 2 A.M. be the closing hour seven days a week for Beer end_TThne_Bars C.O.P.; Liquor Bars C.O.P.; Restaurant, Liquor Beer and Vine C.O.P.; Hotel, Motel, and Apartments; Private Clubs Liquor C.O.P, artd Supper Clubs (being the 2nd, 4th, 5th, 6th, 7th, and 9th categories in Mr. Ferencik's chart). This involves an extra hour for categories 2, 4, 5, and 6 on six days a week but shortens the time in categories 7 and S by one hour. The time for this public discussion will be de- termined and advertised. However, the City. Commission will receive the interim report on Thursday, February 24, 1977, at 9:00 a.m. during the Committee of the Whc+1•_ Session of the Commission Meeting at City Hall, 3500 Pan American Drive. Copies of this interim report are available in the City Manager s Office for any one wishing to personally obtain one. 2/16/77
