HomeMy WebLinkAboutR-77-0188RESOLUTION NO. 77 188 A RESOLUTION RESCINDING RESOLUTION NO, 76712 AND AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT BETWEEN THE CITY OF MIAMI AND GARCIA EQUIPMENT CORPORATION RESCINDING THE CONTRACT ENTERED INTO BETWEEN SAID PARTIES AS AUTHORIZED BY RESOLUTION NO. 76-712 PASSED AND ADOPTED ON JULY 22, 1976. WHEREAS,Resolution No. 76-712, passed and adopted on July 22, 1976, awarded a contract to Garcia Equipment Corporation to demolish certain buildings located at 100 S.E. 2nd Street and 213-217 S.E. First Avenue, Miami, Florida; and WHEREAS, said building located at 100 S.E. 2nd Street was withdrawn from the contract as the City is involved in litiga tion concerning the ownership and tenancy of the building; and WHEREAS, the need for additional space by the Office of Community Affairs and the Department of Human Resources became critical; and WHEREAS, Garcia Equipment Corporation has verbally agreed to the cancellation of the contract to demolish said buildings, NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. That Resolution No. 76-712 is hereby rescinded as to the award of contract to Garcia Equipment Corporation. Section 2. The City Manager is authorized and directed to execute an agreement whereby the contract between the City of Miami and the Garcia Equipment Corporation is rescinded. The demolition of the buildings was subsequently delayed, as the tenant at 100 Southeast Second Street enjoined the City from dispossessing him from the premises. The con- tractor was then notified to demolish only the one story building at 213, 215, and 217 Southeast First Avenue. Before the work could begin, the Office of Community Affairs and the Department of Human Resources expressed a need for this type of location, which is on street level with good exposure. Garcia Equipment Corporation was contacted, and they verbally agreed to cancel the contract. M. Garcia, president of Garcia Equipment Corporation, concerning the possibility of cancellation of contract for the Convention Center Buildings Demolition project. Mr. Garcia is agreeable to cancellation of this contract since he is concerned about the liabilities involved in demolition of the two one-story buildings on parcel 1 while the three—story building on parcel 2 is still occupied. Therefore, as discussed with you on January 4, 1977,.your office should make the necessary arrangements to rescind the award of the contract and/or cancel the contract as required. I am listing the following for your information: 1. Bids received June 30, 1976. 2. Contract awarded to Garcia Equipment Corporation by Resolution Mo. 76-712 on July 22, 1976. 3. Executed contract dccumerts are on file in my office ar::l hive not Leen de11 erect to the contractor. 4. The contractor has verbally agreed to cancellation of the contract. 5. The building at 213 S. E. 1 Avenue is presently occupied by the Citizens Response of Community Affairs. 6. The building at 215 S. E. 1 Avenue is presently being renovated for occupancy by the Department of Human Resources.
