A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO SETTLL PARCEL N. . 7095-2 IN CITY OP
MIAMI V. CISELE PAS1#IR, t T At,, CIVIL ACTION NO
74-21840 (APRICAN SONARS PARR), POR $14,000,00,
EXCLUDING COSTS AND ATTORNEYS' PEES, AND AUTHOR-
IZING AND ntREcTINC THE, PINANCt DIRECTOR TO

TO THE CLERK or THE CIRCUIT COURT
WHEREAS, the City of Miami filed a condemnation action
for the African Square Park project; and
WHEREAS, the court has entered an Order of Taking and
the sum of 812,000.00 has been paid to Philip Sotnberg, et at.; and
WHEREAS, the Defendant has agreed to a settlement of
$14,000.00, exclusive of costs and attorneys' fees; and
WHEREAS, the City Commission finds that said sum repre-
sents a reasonable settlement;
NOW, THFREFORE , BE IT RESOLVED BY THE C0M M C U ION `
THE CITY OF MIAMI, FLORIDA:
Section 1. That the City Attorney be and he is hereby
authorized and directed to settle Parcel No. 7095-2 in City of
Miami v. Gisele Fashik, et al., Civil Action No. 74-21840
(African Square Park), for $14,000.00, excluding costs and
attorneys' fees.
Section 2. That the Finance Director be and he is
hereby authorized and directed to allocate the sum of $2,000.00
from the 1972 Parks for People Bond funds and to pay said sum
to the Clerk of the Circuit Court.
PASSED AND ADOPTED this 24th day of February, 1977.

Our appraisal On the subject property was $13,500,00 or May 1, 1974.
At that time, we would have beet willing to offer the land owter
14,675,00 for the property. / believe that a settlement Of
14,000.00, excluding costs and attorneys' fees, which will be
determined later by the court, is extremely reasonable and,
therefore, I am recommending settlement oft this parcel.
