A RESOLUTION AUTHORIZING AND DIRECTING THE CITY
ATTORNEY TO SETTLE PARCEL NO. 7095*1 IN CITY OF
MIAMI V. GISELE FASHIR, CIVIL SECTION NO. 74*41840
(AFRICAN SQUARE PARK), for $15,500,00, EXCLUDING
COSTS AND ATTORNEYS' PEES, AND AUTHORIZING AND

SUM OF $2, 550, 00 FROM THE 1972 PARRS FOR PEOPLE
FOND FUNDS AND TO PAY SAID SUM TO THE CLERK OF
THE CIRCUIT COURT

WHEREAS, the City of Miattii filed a condetnation action
for the African Square Park project; and
WHEREAS, the court has entered an Order of Taking and
the sum of $13,150,00 has been paid to the Defendant, GISELE
FASHIK; and
WHEREAS, the Defendant has agreed to a settlement of
$15,500.00, exclusive of costs and attorneys' fees; and
WHEREAS, the City Commission finds that said sum repre-
sents a reasonable settlement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. That the City Attorney be and he is hereby
authorized and directed to settle Parcel No. 7095-1 in City of
Miami v. Gisele Fashik, Civil Action No. 74-21840 (African Square
Park), for $15,500.00, excluding costs and attorneys' fees.
Section 2. That the Finance Director be and he is
hereby authorized and directed to allocate the sum of $2,350.00
from the 1972 Parks for People Bond funds and to pay said sum to
the Clerk of the Circuit Court,
PASSED AND ADOPTED this 1OTH day of FEBRUARY , 1977.

ENGLOSURES:
Our appraisal on the above -captioned parcel vas $13,6O0bOO. Under
present condemnation procedures, we would have been willing to
settle with the landowner for $14, 780. 00. l believe that a settle-
ment of $15, 500, 00, excluding costs and attorneys' fees, which will
be determined later by the court, is extremely reasonable and,
therefore, l am recommending settlement on this parcels
