DCA; FOLLOW" BE IT RESOLVED BY THE COMMISSION OP THE CITY OP MIAMI, ?LORIDA Section 1 A policy concerning requests for waiver of fees for the use of public facilities owned and operated by the City of Miami is hereby established. Section 2. The purpose of the herein policy is to uniformly administer the numerous requests for waiver of fees, to assist the City in conforming to existing laws, to encourage activities which benefit the community, and to assist charitable and nonprofit organizations, within legal limits, in worthwhile undertakings. Section 3. In order to accomplish these purposes, the City Commission declares that all requests for waiver of fees for the use of public facilities shall be handled adminis- tratively through appropriate City departments, with final determination of these requests to rest with the City Manager. Section 4. The City Manager shall deny requests for waivers of fees, unless any of the following criteria are found by him to exist. In the event that any one of the following criteria is found by him to exist, he is authorized to `DOCUMENT INDEX grant the requested fee waiver. ITEM NO �, -�-.-r A. Where the project, event, or activa.ty serves' a public purpose by reason of significant positive impact upon the cultural and/or economic well being of the citizens and either (1) no admission is to be charged patrons of the event, CITY COMMISSION MEETING OF FEB 1 01977 d€s©L.unON 3r'+ojeot or activity; or (2) funding provisions have been provided in the annual appropriations ordinance, I, Where the request for the waiver of the fey for the project, event or activity originates from an agency or instrumentality of the United States tovernment, the state, the County, or any other municipality and such use for which a fee waiver is requested is not a part of the normal or routine operations of such aforesaid instrumentality. C. Where the requesting agency is a private or public charity and the City shall have representation Ripon the Board of Directors, Board of Managers, or other governing body and such charity shall have filed with the City Manager a detailed financial report showing all receipts and disbursements by such charity for the twelve (12) month period preceding the request for such waiver. On beceinber 16, 1976, the City Commission approved, by motion, the intent of your proposals concerning the establishment of a fee waiver policy. At this meeting, the Commission requested that the organizations which had previously requested fee waivers for use of City facilities be noti- fied of the impending fee waiver policy adoption. Letters (sample attached) have been sent out. To follow through with your recommendations, I have, in cooperation with the Law Department, drafted the attached Fee Waiver Policy and the proposedReso- lution which will, give this policy effect. Should the Commission adopt this proposed policy by passing the attached resolution, the Commission will have given you the authority to make the required decisions on those fee waiver requests which, in your judgment, meet at least one of the criteria set forth in the Fee Waiver Policy. The City Manager will deny requests for waivers of fees, unless any one of the following criteria is found to exist. In that case he rnav grant the requested fee waiver. 1'. Where the project, event or activity serves a public purpose by reason of significant positive impact upon the cultural and/ or economic well being of the citizens and where either (1) no admission is to be charged patrons of the event, project or activity, or (2) funding provisions have been specifically pro- vided in the annual appropriations ordinance. Where the request for the waiver of the fee for the project, event or activity originates from an agency or instrumentality of the United States Government, the state, county, or any other municipality and this activity is not a part of the normal or routine operations of such agency or instrumentality. 3. Where the requesting organization is a private or public charity upon whose governing body the City of Miami has representation and where such charity has filed with the City Manager a de- tailed financial report showing all receipts and disbursements for the twelve month period preceding the request for waiver of fees.
