A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EWER INTO AN AGREEMENT WITH MORTY FREEDMAN
FOR CONSULTING SERVICES TO THE CITY OF MUM
FOR THE 1977 CITY 'OP MIAMI INTERNATIONAL
FOLK FESTIVAL; ESTABLISHING A FEE OF $7,000
POR SAID SERVICES AND ALLOCATING THE SAID

WHEREAS, the INTERNATIONAL POLIK PES'I'IVAt, is in
its sixth year and has experienced tremendous growth under
the leadership of MR. MORTY FREEDMAN; and
WHEREAS, to insure the continues] success of this
event, the City of Miami should enter into a formal agreement
with Mr. Freedman for providing the consulting services
desired for properly coordinating this activity; and
WHEREAS, funds to cover the cost of these services
have been provided in the 1976-77 Publicity and Tourism Depart-
ment Budget;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF TIIE
CITY OF MIAMI, FLORIDA:
Section 1. The City Manager is hereby authorized to
enter into an agreement with MORTY FREEDMAN for consulting
services to the City of Miami for the 1977 City of Miami
INTERNATIONAL FOLK FESTIVAL.
Section 2. The fee for the UUIftU{`'Iu l
established as $7,000. ITEM NO.__.
Section 3. The amount of $7,000 is hereby allocated
from the Special. Millage Fund of the 1977 Publicity and Tourism
Department Budget

Attached is a resolution and an agreement pertaining to the
International Polk Festival and the agreement with Mr, Morty Freedman
who acts as consultant -coordinator for the City on the Festival.
As you may recall the City has budgeted $19,000 for this event and
pledged an additional $11,000 in in -kind services.
Mr. Freedman has been performing this task since the inception of
the Festival which is held each May and is sponsored by the City of
Miami. The dates of the Festival this year will be May 14 through
May 22.

a municipal corporation of the State of Florida, hereinafter
referred to as "the City", and MOR'r? FREEDMAN, hereinafter referred
to as "the Ce sultant"

WHEREAs, the Commission of the City of Miami, Florida, by
Resolution passed and adopted on ,_„_
authbrited and directed the City Manager and the city
Clerk to enter into an agreement with Mortar Freedman for providing
the consulting services desired for properly coordinating the
International Folk Festival;
NOW, THEREFORE, in consideration of the covenants ` and
affirmations as herein set forth, the parties mutually agree as
follows
1. TERM
The term of this Agreement shall be for a period of one (1)
year, beginning on the llth day of February 1977
andterminatingon the
2. COMPENSATION
The Consultant shall be compensated in the amount of Seven
Thousand Dollars ($7,000.00) from funds budgeted within the
Department of Publicity and Tourism, in increments upon the
following schedule:
$3, 500.00 to be paid on February 11, 1977
$1,750,00 to be paid on APr-i11,, 1977
$1,750.00 to be paid on July 1, 1977

The method of payment shall be by check, issued by the
eity of Miami and made payable to Morty rrecdman, and shall be
delivered by mail or other acceptable means to the Consultant

The Consultant hereby covenants and agrees that he shall:
a) Serve as chairman of the City's International Polk
Festival Advisory Committee.
b) Create, or cause to be created, a budget for the Festival,
which shall be subject to the approval of the city of Miami,
and the Consultant further covenants that he shall ensure
that expenditures will remain within the limits of such
budget.
r) Formulate and carry out all programs and events associated
with the Festival.
d) Supervise the preparation of all brochures, programs, or
other printed material which may be required for Festival
events.
e) Perform all duties which shall be reasonably expected to
be performed by a consultant in the accomplishment of the
herein agreed to objective, to wit: the production of a
successful 1977 City, of Miami international Folk Festival.
AGREEMENTS BY THE CITY
The City agrees that it shall compensate the Consultant for
his services in an amount, and upon a schedule as herein described,
in consideration of the eatiafactory performance of the services

a) That the Consultant shall be deemed to be an independent
oontraCtor and hat an agent or employee of the City, and shall
hot attain any rights or benefits under the Civil Servioe or
Pension Ordinances of the City, or any rights generally afforded
classified or unclassified employees; further, he shall not be
deemed to be entitled to Florida Workmen's Compensation benefits
as an employee of the City; the City shall exercise control over
the manner or means whereby the services of the Consultant are
performed,
b) That either party may terminate this Agreementupon thirty (30)
days written notice to the other party; subject, however, to the
reservation of the City's right to terminate this Agreement
immediately, with or without notice, upon the determination of the
City Manager of the City that the services of the Consultant are
not satisfactory, and upon communication of an appropriate recom-
mendation to the City Manager for disposition.

That the Consultant shall make no assignment of this Agreement,
unless prior written consent of the City Manager is obtained.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement on the day and date first above written.
