HomeMy WebLinkAboutR-77-0101RESOLUTION NO. 771.,_ A RESOLUTION AUTf ORI2tNG THE CITY MANAGER TO ENTER INTO THE ATTACHED AGREEMENT WITH THE GREATER MIAMI TRA`PIC ASSOCIATION POD A PERIOD OE ONE YEAR COMMENCING OCTOBER 1r 1976 AND ENDING SEPTEMBER 10, 1977 AND TO PAY THE SUM OP $20,000 FOR SERVICES RENDERED BY THE ASSOCIATION; HEREBY ALLOCATING $10,000 PROM SPECIAL, PROGRAMS AND ACCOUNTS AND $10,000 FROM THE CONTINGENCY PUND, BE IT RESOLVED BY THE COMMISSION OF THE CITY OP MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to enter into the Agreement, attached hereto and made a part hereof, with the GREATER MIAMI TRAFFIC ASSOCIATION for a period of one (1) year, commencing October 1, 1976 and ending Septem- ber 30, 1977, and to pay the sum of $20,000 for the services rendered by said Association, with funds therefor hereby allocated as follows: $10,000 from Special Programs and Accounts and $10,000 from the Contingency Fund. CITY ATTORNEY MAYOR "DOCUMENT INDEX ITEM NO.-57 CITY COMMISSION MEETING OF AN l 1977 mum 00,,77r e! / AGREEMENT THIS AGREEMENT, Made and entered into this day of 1577, by and between the CITY OP MIAMt, V ,ORIDA# a municipal corporation located in bade County, 'lorida (hereinafter referred to as the "City''), Party of the First Part, aid GREATER MIAMI TRA`FIC ASSOCIATION, a Florida nbn-profit organization existing under the laws of the State of Florida (hereinafter referred to as the "Association'+), Party of the Second Part, WHEREAS, pursuant to Resolution No. the City Commission has authorized and directed the City Manager and City Clerk to enter into an agreement with the GREATER MIAMI TRAFFIC', ASSOCIATION for the following services for a period of one (1) year, commencing October 1 , 1976 and terminating September 30 1977; NOW, THEREFORE, in consideration of the mutual covenant and agreement hereafter set forth, the parties hereto covenant and agree as follows: "SUPP RTI aIE DOCUMENTS THE ASSOCIATION AGREES:FOLL_ �' (a) That it will promote and ex ends the trade of the Greater Miami area in Dade County, Florida, by attempting to secure adequate transportation services and proper freight, passenger and express rates, both intrastate and interstate, to and from said area and between points in said area by every form, means or agency of transportation. (b) Handle and assist in matters pertaining to transportation. (c) Endeavor to secure rates that will compare favorably with rates of other places and thereby prevent discrimination against the Greater Miami area. (d) Endeavor to secure the revision and classification of such items of freight as are considered to be improperly classified. (e) Invite the cooperation of transportation companies and agencies to harmonize and promote the interests of both shipper and carrier. AOR t8! (a) That the amount of compensation to be paid to the Association shall be $20,000.00. BOTH PARTIES AGREEt (a) That all services to be performed by the Association shall be in accordance with policies, rules and regulations of the City of Miami. (b) That the term of agreement shall be for one year, commencing October 1 1976 and terminating September 30. , 1977. It is understood and agreed that the scope of the services to be rendered by the Association shall not extend to those of an unusual or non -recurring nature or those involving extensive litigation or the employment of financial, legal, accounting, transportation, or other exports for a particular proceeding, but shall be confined to those services as set forth in Paragraph II thereof. It is mutually understood and agreed that the Association shall make a report of its activities to the City Manager on a semi-annual basis. Paredes Assistant City Manager bAtE JAN 17 3177 tttr.rE!:CE3 • A reetnent• With the Greater Miami Traffic Ass6e1ation• • On October 28, 1976, the City Commission adopted Motion No. 76-959, a Motion of Intent to provide the Greater Miami Traffic Association $20,000 for their services. During the adoption of the 1976-77 Budget, only $10,000 was appropriated for this purpose. Therefore, in order to provide the necessary funds, enclosed is a resolution providing $10,000 from the originally allocated special programs and accounts and the additional $10,000 necessary from the Contingency Fund. Also, an Agreement is being provided, since the City has not entered into a new Agreement with the Greater Miami Traffic Association since 1967, and has only been updating the original Agreement by a letter of understanding. In the new Agreement, it is stipulated that the Greater Miami Traffic Association will provide the City Manager with a semi-annual report on the services that they provide to the City of Miami.
