HomeMy WebLinkAboutR-77-0079RPC/r1 1 /2 /16 RESOLUTION NO A RESOLUTION AUTHORIZING THE CITY MANAGER TO SUBMIT A GRANT APPLICATION TO THE BUREAU OR CRIMINAL JUSTICE PLARNING & ASSISTANCE, DIVISION OP STATE PLANNING, DEPARTMENT OP ADMINISTRATION, STATE OP PLORIDAI ?OR PUNbING OP THE LEGAL INPORMATION, DEFINITION, RETRIEVAL, AND EWALUATI0N (I,. t, b. R. E.) PROJECT; PROVIDING ?OR AN APPROPRIATION OP $3,750 AS THE CITY'S CASH MATCH/NO FUND PROM THE SPECIAL PROGRAMS AND ACCOUNTS OP THE 1976-77 PISCAL YEAR BUDGET; AND FURTHER AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AND EXECUTE THE NECESSARY AGREEMENTS TO IMPLEMENT THE PROGRAM UPON RECEIPT 0P THE GRANT. WHEREAS,, the City Commission, after thorough consider- ation of the problem and available data, has hereby determined that the development of a computer system to provide instant access to legal data for police officers whereby the essential elements of offenses may be constantly and currently reviewed for necessary modifications in departmental procedures for the purpose of improving conviction rates, said project being designated as the Legal Information, Definition, Retrieval, and Evaluation (L.I.D.R.E.) Project is in the best interest of the general public; and WHEREAS, under the terms of Public Law 90-351, as amended, the United States of America has authorized the Law Enforcement Assistance Administration (LEAA), through the Florida Bureau of Criminal Justice Planning and Assistance, to make Federal Grants to assist local &m rn irk Dimprove ment of criminal justice; and ITEM NO WHEREAS, the City Commission has examined and duly considered such Act and considers it to be in the public interest and to the benefit of the City of Miami to file an application under said Act and to authorize other action in connection therewith; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA Section 1. The City Manager is hereby authorized to file in behalf of the City an application in the ford prescribed by the rlorida Bureau of Critnal d'ustide planning and Assistance in conformity with public taw 90-351, as amend+ for a grant to be trade to the City to assist in defraying the cost of the project generally described above. Section 3. If such grant be macde, the City shall provide or make necessary arrangements to provide such funds and/or in -kind contributions in addition to the grant as may be required by the said Act to defray the cost of the project generally described above. Section 4. The City is aware that at least 50% of the minimum required non-federal cost of the project be appro- priated cash and that such City funds designated as local hard cash contributions in all related project. budget schedules that are to be provided by the City are hereby appropriated new City funds for Criminal Justice use for the express purpose of match- ing the LEAA funds and have been provided for in the 1976-77 City Fiscal Year Budget in the amount of $3,750. Section 5. The City Manager is hereby authorized to furnish such information and take such other action as may be necessary to enable the City to qualify for said grant and to accept the grant and execute all ment the project upon receipt of ATTEST: necessary agreements to imple- the grant. Grassie City Manager bAtt: SUitCt• ti4S,A.A.Mgt The Miami Police beparttent is now in the process of drawing Up final application for Legal Information, befirnition, Retrieval, and Evaluation (L.I.b.!.E.) pronounced "Leader". This project is funded through a L.E.A.A. Grant and local matching funds. The purpose of this grant is to accomplish the following objectives: 1. To define an average of 4 elements for each of 1500 criminal statutes and penal ordinances for presentation to the police officer in the field. 2. To design and program a computer system for the collection, storage, validation, update, and dissemination of legal data to the police officers. 3. To update and maintain these legal elements based upon legislative and judicial changes as follows: e. Legislative updates; 250 elements changed and/or added. b. Judicial updates; 250 elements changed and/or added. 4. To design and program a computer system to present by officer, by unit, and department wide the conviction rate for each 1500 criminal statutes and criminal ordinances, thereby determining the need for modification to the elements. 5. To evaluate within the legal office the necessity for modifi- cation of each of the 6000 elements contained in the system to result in approximately 500 modifications in departmental procedural elements for the purpose of improving conviction rates. -tt The Honorable Members of the City Commission Method of funding is as Poll LEAA Grant Amount State Buy•In'.
