COMMISSION IN LIEU OF THE CITY •MAKING A CONTRIBUTION
ON:BEHALF OF THE AFORESAID INDIVIDUALS TO_.,THE MIAMI
CITY GENERAL EMPLOYEES* RETIREMENT PLAN; ALSO
• PROVIDING THAT THE CONTRIBUTION MADE BY THE. EMPLOYEE,
MEMBERS OF THE RETIREMENT PROGRAM SHALL BE MADE AT A
RATE OF NOT LESS THAN"5% OF THE INDIVIDUAL's ANNUAL
SALARY; PROVIDING THAT IN ORDER TO PARTICIPATE IN
THE HEREIN RETIREMENT PROGRAM, SAID INDIVIDUALS
SHALL, WITHIN SIX MONTHS FROM THE EFFECTIVE DATE
HEREOF OR WITHIN ONE YEAR FROM THE DATE OF THEIR
EMPLOYMENT WITH THE CITY OF MIAMI, SUBMIT TO:THE CITY
COMMISSION A WRITTEN RETIREMENT TRUST AGREEMENT WHICH
WILL PROVIDE. FOR THE ACCEPTANCE:BY:THE INDIVIDUALS
OF THE HEREIN -RETIREMENT PROGRAM"IN LIEU"OF:MEMBERSHIP
IN.THE MIAMI CITY GENERALEMPLOYEES'_RETIREMENT PLAN;
ALSO PROVIDING THATWITHIN THE AFORESAID TIMEPERIOD
A SECOND RETIREMENT TRUST AGREEMENT BETWEEN THE CITY
OF.MIAMI AND THE. AFORESAID PUBLIC TRUST FUND SHALL BE
.SUBMITTED BY THE INDIVIDUAL TO THE'CITY COMMISSION FOR
ITS APPROVAL AND EXECUTION;' ALSO PROVIDING"THAT THE
-AFORESAID SECOND- AGREEMENT AUTHORIZE.THE CITY TO TRANSFER
THE: CONTRIBUTIONS OF BOTH THE INDIVIDUAL AND THE CITY"TO
THE; AFORESAID PUBLIC TRUST FUND;'.PROVIDING:THAT AT NO
TIME SHALL ANY -MEMBER. OF THE HEREIN RETIREMENT PROGRAM
ENJOYACTUAL,OR CONSTRUCTIVE RECEIPT OF HIS ORHER CON-
TRIBUTIONOR THOSE'MONIES CONTRIBUTED.ON:HIS OR -HEW,
BEHALF BY THE CITYOF MIAMI PRIOR TO REACHING AGE 55.
OR BECOMING:DISABLED; FURTHER PROVIDING THATUNDER:
NO CIRCUMSTANCES. SHALL ANY OF THE ABOVE INDIVIDUALS

BE PERMITTED TO REJECTSUCH MEMBERSHIP IN EITHER OFTHE
AFORESAID=RETIREMENT. PLANS;"REPEALING ALL ORDINANCES,1
CODE SECTIONS OR PARTS THEREOF'INCONFLICT, INSOFAR AS
THEY ARE IN CONFLICT; AND CONTAINING A SEVERABILITY
PROVISION.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA;

1956, as amended) Within one year from his or. her Commencement of
employment, or within sik months : from the effective date hereof,
Whichever is later, subject to performance of the conditions set
forth in Subsections (a) and (b) hereof, Within the aforesaid time
periods: City Manager, City Attorney,: City Clerk Assistant City
Manager. Deputy City Attorney, Assistant City Clerk, Executive Secretary
of the Civil Service Board, Executive Secretary of the Planning and
Zoning Board, City Physician, Director of a Department established
by the Charter of the City of Miami or by ordinance as authorized by
such Charter, Assistant Director of a Department; Community Affairs
Director; Assistant Community Affairs Director; Labor Relations Coordina-
tor; Assistant Labor Relations Coordinator; Assistant to the City
Manager III, Assistant to the City Manager II.
(a) Submission to the City Commission of,a written trust
agreement wherein the employee rejects membership in the Miami City
General Employees' Retirement Plan and wherein provision is made for
the City to contribute to a public trust fund, designated by the
employee and approved by the City Commission, monies on behalf of said.
employee; such herein contribution to be made in lieu of the City's
contribution on behalf of the employee to the Miami City General
Employees' Retirement: Plan:.
(i) The rate of the herein contribution to be made by
the City under the terms of the above agreement
shall be eight percent of the individual's annual
salary;
(ii) A contribution to said public trust fund must be
made by the employee so rejecting membership in
the Miami City General. Employees' Retirement Plan
and such contribution by the employee shall be
made at a rate of not le§d than five percent
of the individual's annual saiety.
(b) submission to the City cy tMiS@ion of an addi-
tional written trust agreement ekeduted by the trustees of the
public trust fund designated in (a) above, whieh agreement must
also be approved by the Commission wherein the City is authorited
to transfer the contributions both of the employee and the City to
said public trust fund and wherein provision is made that at no
time shall any employee hereunder enjoy `
actual or constructive
receipt of his or her contribution or those contributions made
by the City on his or her behalf prior to reaching age 55 or becoming
disabled:
(i) The said additional agreement shall provide that
all contributions deposited in the public trust
fund at any time with any earnings thereon remain
assets of the City at all times subject to its,
absolute dominion, control and right of withdrawal;
(ii). Neither the employee or his or her beneficiary shall
have any interest or claim, by way of trust, escrow,
annuity or otherwise in and to the specific monies
and assets deposited in the fund; neither shall they
be entitled to commute, encumber, sell or otherwise
dispose of the employee's right to receive benefits
provided by the agreement.
(c) If an inividual employed in, any of the aforesaid positions
shall not have complied with all, of the conditions prescribed above, he
or she shall not have the right to reject membership in the aforesaid
Retirement Plan,
Section 2. All ordinances, code sections, or parts thereof
in conflict herewith are hereby repealed.
Section 3. If any section, sentence, clause, phrase, or
word of this Ordinance is for any reason held or declared to be
unconstitutional, inoperative or void, such holding or invalidity
shall not affeot the retiainifig piftibiip of this bfdinanoe, and '

It is requested that the Law f)epartn-o7nt prepare an .appropriate ordinance
that will grant the City Manager the authority to appoint one additional
member to the City's Retirement Plan 13oard. This position that the City
Manager would appoint would replace the position now held by the City
Manager.
In effect, the City Manager would be naming the individual to fill his
vacated po3ition and would continue to fill this position by appointment.
