RESOLUTION GRANTING A SIX-MONTH EXTENSION OF THE
CONbtTIONAL USE AS LISTED IN ORDINANCE 6871, ARTICLE
XV, SECTION 2 (8) (a) , TO PERMIT CONSTRUCTION OF PARKING
GARAGE ON LOTS 12 THRU 16, BLOCK 1, NELSON VILLA &
GARDEN OF EDEN AMD (30-20) & UNPLATTED, BEING APPROXI-
MATELY 535 N. E. 15TH STREET, FOR 475 CARS IN CONJUNC-
TION WITH PROPOSED APARTMENT BUILDING, SUBJECT TO THE
FOLLOWING CONDITIONS:
1. LANDSCAPING & SITE PLANNING PORTION OF WORKING
DRAWINGS SHALL BE SUBJECT TO APPROVAL BY PLANNING
DEPARTMENT.
REGISTERED LANDSCAPE ARCHITECTURAL CONSULTANT BE
EMPLOYED FOR DESIGN & SITE PLANNING OF LANDSCAPING
WHICH INCLUDES THE 16TH STREET PEDESTRIAN MALL &
THAT PORTION OF TRINITY CHURCH ADJACENT TO THE
PROJECT.
PROPERTY BE PLATTED WITH DEDICATION OF 12.5 FEET
OF 16TH STREET ADJACENT TO THE ZONED RIGHT-OF-WAY
LINE.
16TH STREET BE DEVELOPED AS A LANDSCAPED PEDESTRIAN
MALL & THAT THE DEVELOPER MAINTAIN THAT PORTION OF
MALL ADJACENT TO THE PROJECT.
A CONTINUOUS LANDSCAPED PLANTER BE PROVIDED ON THE
OFF-STREET PARKING GARAGE & RECREATION DECK AS
INDICATED IN PRELIMINARY DRAWINGS.
LANDSCAPE TREATMENT ON TWENTY-SIX FOOT AVERAGE
WATERFRONT AREA & OTHER GROUND LEVEL AREAS BE PRO-
VIDED.
AN OPEN GROUND FLOOR VISTA FROM TRINITY CHURCH TO
BISCAYNE BAY THROUGH THE COMMERCIAL AREA BE PROVIDED.
A SCULPTURED WALL & WATERFALL TREATMENT ON THE WEST
SIDE ADJACENT TO TRINITY CATHEDRAL BE PROVIDED.
ONED C-3 (CENTRAL COMMERCIAL); GRANTED BY ZONING BOARD
RESOLUTION NO. ZB-125-76.
WHEREAS, Article XXXII of the Comprehensive 'oning Ordi-
ance No. 6871 permits an extension of a conditional use by the
City Manager with approval by the City Commission, for a six-
month Period; and
WHEREAS, the City Manager recommends a six-month extension
of the conditional use granted by Zoning Board Resolution No.
ZB-125-76;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
TY OF MIAMI, FLORIDA:
Section 1. The request for a six-month extension of the
,nditional use as listed in Ordinance No. 6871, Article XV,

subject to the following conditions:
1. . Landscaping & site planning portion of working draw-
ings shall be subject to approval by Planning Department.
2. Registered landscape architectural consultant be
employed for design & site planning of landscaping
which includes the 16th Street pedestrian mall & that
portion of Trinity Church adjacent to the project.
• Property be platted with dedication of 12.5 feet of

• An open ground floor vista from Trinity Church to
Biscayne Bay through the commercial area be provided.
• A sculptured wall & waterfall treatment on the west
side adjacent to Trinity Cathedral be provided.
Zoned C-3 (Central Commercial),
granted by Zoning Board Resolution No. ZB-125-76, be and the
same is hereby granted.

ENCLOSURES:
ARTICLE XXXII of the Comprehensive Zoning Ordinance No. 6871 provides
that any Conditional Use shall expire six months after the effective
date of the Conditional Use unless a Building Permit or a Certificate
of Use has been issued based upon the Conditional Use. The review and rdinanie

Dear Mr. Grassie:
We enclose a copy of a letter received from the Department of Administration,
Planning & Zoning Boards dated July 28, 1976, and the two captioned resolu-
tions. We did not respond to the above for we fully intended we would be
underway with permit and construction well before the expiration date,
January 12, 1977.
As you know the entire OMNI and Plaza Venetia area has had very extensive
construction by the State D.O.T. as well as the City of Miami Public Works
Department; in that Bayshore Drive, N.E. 15th Street (Venetian Causeway) and
verious other ancillary streets are being raised an average of 32" from their
present grade. These works commenced in the first half of 1976 and I am told
by the contractors that they will continue probably for an additional 180
days before they reach conclusion.
Therefore, in accordance with the provision, we respectfully request an
extension of time for one year by the City Manager with approval by the City
Commission, be granted.
We fully intend to proceed with construction of the project as soon as possi-
ble. Although we do not expect to fully use a one year extension, we could
breathe easier if the full year were granted.
We would be deeply appreciative of an affirmative reply to our request.
