AND BY MAKING THE NECESSARY CHANGES IN THE
ZONING DISTRICT MAP MADE A PART OF THE SAID
ORDINANCE NO. 6871 BY REFERENCE AND DESCRIPTION
IN ARTICLE III, SECTION 2 THEREOF; BY REPEALING
ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF
IN CONFLICT; AND CONTAINING A SEVERABILITY
PROVISION.
WHEREAS, the Miami Planning Advisory Board at its meeting
of November 10, 1976, Item No. 2, following an advertised hearing,
adopted Resolution No. PAB 32-76 by a 6 to 0 vote recommending
changing the zoning classification as hereinafter set forth; and.
WHEREAS, the City Commission, after careful consideration
and due deliberation of this matter, deems it advisable and in the
best interest of the City of Miami and its inhabitants to grant
said petition;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA;
Section 1. Ordinance No. 6871, the Comprehensive Zoning
Ordinance for the City of Miami be, and the same is hereby amended
by changing the zoning classification of certain properties
generally located on and adjacent to Martin Luther King, Jr.
Boulevard, from 1-95 to N.W, 17th Avenue, presently zoned R-4
(Medium Density Multiple), Cr1 (Local Commercial), C-2 (Community
Commercial), and C-4 (General Commercial), to C-4A (Boulevard
Commercial) District; adding a designation of Transition Use Area
tocertain contiguous areas presently zoned R-1 (One Family), R-2
(Two Family) and R-3 (Low Density Multiple), all as shown on the
ma and legal description atCompositeExhibit A;

Section 2. That all laws or Batts of 1ats in conflict

Section 3, Should any part or provision of this ordinatice
be declared by a,court of competent jurisdiction to beinvalid, the
same shall not affect the validity of the ordinance as a whole.

purpose and intent of ordinance #9212 "Or. Martin,'
Luther ling Jr. interim Zoning District" adopted
by the City Commission on November 21, 1974, having
expired on July 22, 19 76 .
RECOMMENDATION
PLANNING APPROVAL in accordance with the plan for Dr. Martin,
DEPARTMENT Luther King Jr. Boulevard adopted by the Model Citie-
Governing Board in October 1974.
Recommended Approval by Resolution PAB 31-77 by a
6-0 vote two (2) members absent.

Three public hearings were held in the community.
having a combined attendance of approximately two
hundred persons. A majority of those in attendance
participated in the hearing process by raising per-
tinent questions on the ordinance's effect upon
existing and new development., Twenty persons
spoke in favor of the new ordinance.. Four persons
spoke agains the ordinance citing their reasons:
-- Restricting wholesale and manufacturing uses.
-- Providing an overabundance of commercial uses.
--,:prohibiting outdoor advertising
--creating non -conforming uses.
Nineteen written objectors' comments were received.
Adopted on first reading on 12-15-76 and directed the
administration to prepare a more definitive boundary
description and map. (See attachment)
