As per your request, the following information is submitted concerti
ittg the fire ap.paratus presently owned by the City of West Miami and
soon to be traded with the City of Miami.
This apparatus is a 1953 Ford F7 with a 500 GPM, 2-stage centrifugal
American LaFrance pumper equipped with a 500 gallon water tank. The
truck is in fain condition and has 20,000 road miles registered since
the engine was rebuilt. The pump is in need of overhaul, however, and
the exterior pnint is deteriorating,.
The approximate cost to ship this ;apparatus to Cali, Columbia via ship;
board freight is $3,000.

Itt accordance With your request (your memorandum "Exchange of
Fire Equipment" October 14, 1976), the proposal to exchange two
obsolete pumpers for one pumper has been reviewed. The proposed
exchange would be between the City of Miami and the City of West
Miami.
Your memorandum expresses concern over the possibility of liability
claims arising from the exchange. No significant liability is
apparent from the facts cited. The City is authorized to dispose
of public property without limitation of the means of such disposal
(Charter, Section 3 (f) ). Presumably, the value of the two obsolete
pumpers is roughly equivalent to the one to be exchanged, taking into
consideration the retained right to use one of the pump
ers inemergency.
The City is not a manufacturer or a designer of the equipment,
therefore it would not ordinarily be liable for faulty construction
or design. However, since the two pumpers are obviously old, it
would probably be advisable to deliver them accompanied by a letter
advising the recipient that they are delivered "As Is" and no
warranties of any kind as to their condition are extended or should
be implied.

Dear Mayor Ferre:
I express the gratitude of the City Council for the
most generous act of the City Commission of the City of
Miami in the exchange of two fire engines for one City of
West Miami fire engine.
The significant meaning of the exchange is the willing-
ness of the City of Miami fathers - cognizant of their own
difficult struggle for the survival of their community - to
lend a helping hand to their colleagues in a small, neigh-
boring community. I believe you acted in the realization
that much of the value of the American way of life lies in
the continued existence of local self-government.
The City Council authorized the exchange on November 11,
1976 of the West Miami 1954 Fire Engine 1 for City of Miami
1957 Ford-Seagrave Engine 11 and 1961 Ford American La France
Hose 5.
