RESOLUTION ACCEPTING THE PLAT ENTITLED PERCIVAL ARDENS, A SUBDIVISION IN THE CITY OF MIAMI, AN1 ACCEPTING THE DEDICATIONS SHOWN ON SAID PLAT, AND AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT, WHEREAS, the City Zoning Board and the Department of Publ., fko have recommended the acceptance of the plat; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. THE Plat entitled PERCIVAL GARDENS being a re - subdivision of Lots 16, 17, 18 and Lots 20 through 34 of PERCIVAL AND SANFORD REVISED and that portion of Higgs Street between Lots 17, 18, 28 and 29, according to the plat thereof, as recorded in Plat Book 1, at Page 140, of the Public Records of Dade County, lying in Section 20, Township 54 South, Range 41 East, City of Miami, Florida. Section 2. The City Manager and the City Clerk, both of the City of Miami, Florida, are hereby authorized and directed' to execute the Plat. It is zoned R-1, R-2 and C-2. This plat is being forwarded to your office for City Commission action. The attached detailed report from the Department of Public Works, recommends the aprroval of the plat by the City Cormlission of Miami, Florida, and certifies its correctness as to form. Also attached are the followin: itemized ravers necessary to present the Plat to the City Co=ssion of Miami: (1) Form of Resolution accepting the (2) Print of proposed Record Plat (3) Opinion of Title (4) Memorandum from the Department of Planning waiving landscaping requirements (5) Memorandum from the Miami -Dade Water and Sewer Authority waiving the requirement to install water mains and appurtenances (6) Portion of City Atlas Sheet No. 47 showing property platted colored in red WEP:WKB:met r . , Stbc q.t... • , . Martinez & Associates, Inc. It is in correct form for submission to the City Commission and is forwarded with a recom- mendation that it be approved. PERTINENT INFOR:.1,ATION REGARDING THE PLAT: (1) The property platted is a replat of a previously recorded subdivision having a total area of 2.92± acres. It is zoned R-1, R-2 and C-2. (2) The location of the streets and the widths conform with the standards of the Department of Public Works of the City of Miami, Florida. As certified to by Juan R. Martinez, Registered Land Surveyor, this Plat complies with the plat filing laws of the State of Florida. (4) The City Zoning Board of Miami, Florida, after Public Hearing, has recommended the closing of Higgs Street between Percival Avenue and Day Avenue. This action was confirmed by City Commission Resolution No. 75-3. By authority of Resolution No. ZB-21-7, adopted February 24, 1975, the Plat was recommended for acceptance by the City Zoning Board of Miami. (6) The attached Certificate of Title Examination dated September 24, 1976, signed by R, A. Cuevas, Jr„ Attorney, indicates that the fee simple title to the property plotted is correctly vested in Dade County and the Plat has been correctly executed.
