I, USAIN BOLT, acknowledge that I have voluntarily applied to participate in conducting filmed physical activity, specifically involving movement throughout the stadium grounds, including traversing various areas of the stadium grounds (the "Activities") at the Commodore Ralph E. Munroe Marine Stadium, located at 3501 Rickenbacker Causeway, Miami, FL 33149, as further defined in Section 53-51 of the City of Miami Code of Ordinances, hereinafter referred to as the "PROPERTY". I am aware that the Activities are hazardous activities. I am voluntarily participating in these activities with knowledge of the danger involved and assume any and all risks of injury, death, or property damage. I expressly acknowledge that the stadium premises has been declared an unsafe structure and that the activities contemplated herein may involve inherent and significant risks. Accordingly, I agree to indemnify, defend, covenant not to sue, and hold harmless forever the City and all the City's members, officials, officers, agents and employees (collectively referred to as the "Indemnitees") from and against any and all losses, costs, penalties, fines, damages, claims, expenses (including attorney's fee and costs), and liabilities (collectively referred to as "Liabilities") arising out of or related to (a) the condition of the stadium premises and the Property as an unsafe structure, and (b) the inherent dangers and risks associated with the Activities conducted on the Property, regardless of whether such Liabilities arise from known or unknown conditions. In consideration of being permitted by the City and its affiliated organizations to participate in these activities and to use their facilities, I agree that I and my heirs, distributees, guardians, legal representatives, and assigns will not make a claim against, sue, attach the property of, or prosecute the City or any of its affiliated organizations for any injury, death, or property damage occurring to me as a result of my participation in the Activities at the Property, whether caused by the negligence of the City or otherwise. In addition, I release and discharge the City and its affiliated organizations from all actions, claims, or demands that I and my heirs, distributees, guardians, legal representatives, or assigns now or in the future may have for any injury, death, or property damage resulting from my participation in the Activities conducted at the Property. I agree for myself and my heirs, distributees, guardians, legal representatives, and assigns that in the event that any claim for personal injury, death, or property damage shall be prosecuted against the City or any of its affiliated organizations, I shall indemnify and save harmless the City and its affiliated organizations from any and all such claims or causes of action by whomever made and wherever presented. The parties shall be entitled to sign and transmit an electronic signature of this Agreement (whether by facsimile, PDF or other email transmission), which signature shall be binding on the party whose name is contained therein. Any party providing an electronic signature agrees to promptly execute and deliver to the other parties an original signed Agreement upon request.
