HomeMy WebLinkAboutR-26-0043City of Miami Resolution R-26-0043 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18761 Final Action Date: 1/22/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER AND CITY ATTORNEY TO PREPARE AND PRESENT AN ORDINANCE AMENDING ALL PROVISIONS OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, THAT REQUIRE AN ORDINANCE TO AMEND ESTABLISHED FEES, IN ORDER TO AUTHORIZE THE CITY COMMISSION TO APPROVE FEE CHANGES BY RESOLUTION TO BE CONSIDERED BY THE CITY COMMISSION AT THE MARCH 12, 2026, CITY COMMISSION MEETING; FURTHER DIRECTING THAT ALL FEE SCHEDULES BE MAINTAINED BY THE CITY MANAGER AND RETAINED FOR PUBLIC VIEWING BY THE CITY CLERK AND POSTED ON THE CITY OF MIAMI'S MAIN WEBSITE AND ON THE WEBPAGE OF EACH RELEVANT DEPARTMENT. SPONSOR(S): Commissioner Ralph "Rafael" Rosado WHEREAS, currently, nearly all City of Miami ("City") fees are set forth with specificity in the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, any amendment to such fees, whether related to permitting, rentals, or other charges, requires the adoption of an ordinance by the City Commission, which entails two (2) readings; and WHEREAS, at times, multiple fees within different sections of the same chapter are amended concurrently, resulting in frequent updates and delays in providing accurate information to the public due to fees being located across various chapters of the City Code and any potential codification delays; and WHEREAS, maintaining all fee schedules in a single, centralized chart available for public review on the City's website and through each relevant department would improve transparency, reduce confusion, and save time and resources for residents, businesses, and City staff; and WHEREAS, authorizing fee changes by resolution, rather than by ordinance, would streamline the approval process by reducing it from two (2) readings to one (1); and WHEREAS, the City desires to eliminate separately located fee schedules throughout multiple sections of the City Code and to adopt a uniform process whereby all fee changes are approved by resolution and maintained by the City Manager and retained by the City Clerk and on the City's website and the several relevant Departments; and WHEREAS, this updated process would allow the City Commission to more efficiently implement fiscally sound policies and best practices consistent with City regulations and changing market conditions; City of Miami Page 1 of 2 File ID: 18761 (Revision: A) Printed On: 2/5/2026 File ID: 18761 Enactment Number: R-26-0043 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the preamble to this Resolution are hereby adopted by reference and incorporated herein as if fully set forth. Section 2. The City Manager and City Attorney are hereby directed to prepare an Ordinance amending all provisions of the City Code that require an Ordinance to amend established fees, in order to authorize the City Commission to approve fee changes by Resolution with such Ordinance presented at the March 12, 2026, City Commission meeting. Section 3. The City Manager and City Attorney are further directed to include requirements in such ordinance that all fee schedules be maintained by the City Manager and retained for public viewing by the City Clerk and posted on the City's main website and on the webpage of each relevant department.
