WHEREAS, the City Commission adopted Ordinance No.8731 on
December 16, 1977 establishing revenues and appropriations for the City
of Iiiami, Florida for the fiscal year ending September 30, 1978; and
WHEREAS, the ACTION Community Center Program is a social
service program administered by the Department of Citizen Services and
funded by Federal Revenue Sharing - Social Service Programs; and
WHEREAS, the ACTION Community Center Program was reduced
as a result of the reduction in the amount of Federal Revenue Sharing
available to social service programs in FY'78; and
WHEREAS, at the request of participants in the above mentioned
program, the City Commission directed the Administration to find the
additional funds requested; and
WHEREAS, an amount of $20,694 in additional funds is
required by the aforementioned program for the 1977-78 fiscal year; and
WHEREAS, funds are available from prior years' balances in
the Street Lighting end and an amount of $20,694 can be appropriated
to the General Fund, Social Service Programs for funding the Action
Community Center Program;
NOW, THEREFORE, BE I1 ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Section 1 of Ordinance No 8/31, adopted December 16, 1977, as
amended, is hereby further amended as follows:1/
"Section 1. The following appropriations are made for muncipal
operations of the City of Miami, llorida for the fiscal year 197778,
including the payment of principal and interest on all General
Obligation Bonds.

The herein increased amount of $20,694, is appropriated from the Street
Lighting Fund into the General Fund, Special Programs and Accounts,
Social Service Programs for the ACTION Community Center Program,
Section 3. All Ordinancet or parts of ordinaneet intofar as they art
iheohtitteht or In conflict With the provisions of this ordinate are hereby
repealed.
Section 4. If any section, part of teCtion, paragraph, Clautt, phrate, Or
word of this ordinance is declared invalid, the remMning provisions of this
ordinance shall not be affected.
Section 5. This ordinance is hereby declared to be an emergency measure
on the grounds of urgent public need for the preservation of peace, health,
Safety, and property of the City of Miami, and upon the further ground of the
necessity to make the required and necessary payments to its employees and
officers, payment of its contracts, payment of interest and principal on its
debts, necessary and required purchases of goods and supplies, and to generally
carry on the functions and duties of its municipal affairs.
Section 6. The requirement of reading this ordinance on two separate days
is hereby dispensed with by a vote of not less than four -fifths of the members
of the Commission.

The Action Community Center Program administered by the Citizen Services
Department has experienced a reduction in funding as a result of the
■ reduction in Federal Revenue Sharing Funds available to City of Miami
social service programs. As a result, the director of the program re-
quested additional funding from the City.
On February 23, 1978 the City Commission passed Motion 78-142 "authorizing
and directing the City Manager to find the necessary funds for the Action
■ Community Center Program, as previously committed...." A proposal was made
to fund the program with three CETA positions, but was subsequently rejected
due to the requirement that participants be unemployed for 30 days.
In June, at the request of the Director of Management and Budget, represen-
tatives of the Citizen Services Department met with a principal from the
Action Community Center to establish a balance for the fiscal year 1977-78
line -item budget. This is itemized in the attached memorandum of June 20,
1978, with the balance of the fiscal year budget equalling $20,694.
Combined with the original allocation of $26,730, this provides a total
allocation to the agency of $47,424.
The attached proposed ordinance provides for an amount of $20,694 to be
appropriated from the Street Lighting Fund into the General Fund, Special
Programs and Accounts, Social Service Programs, for the ACTION Community
Center Program.

The above referenced Agency was originally allocated $26,730 in 1977/78 Federal
Revenue Sharing funds for social services purposes. This allocation was accompanied
by an additional allocation of three CETA positions that would have provided a total
allocation of $56,730 maximum. We were unable, however, to reach an agreement with
the Agency related to the three CETA positions. This lack of agreement was based
upon,the requirements of CETA that, under Title II, participants must be unemployed
for 30 days before being placed into the CETA positions. The Ag-ency's intent was
to continue existing personnel, consequently, they would have had to lay off three
existing members of their staff.
Following attempts to conclude the allocation of the three CETA positions, a repre-
sentative of Action Community Center appeared before our Commission and requested
$30,000 in cash in lieu of the three CETA positions. Generally it would appear that
the Commission intended to provide up to $30,000, and asked that the Administration -
I believe - determine the availability of these funds for allocation to the Agency.
In the interim, the Commission generally provided for a 1/12 allocation per month
based upon the original $26,730.
In June, at the request of the Director of Management and Budget, representatives of
the Citizen Services Department met with a principal from the Action Community Center
in order to establish a balance of the fiscal year • line item budget. This was
concluded and itemized in the attached memorandum of June 20, 1978, with the balance
of the fiscal year budget equalling $20,694. This, combined with the original
allocation, provides for a total allocation to this Agency of $47,424. Currently,
the Agency has been reimbursed for expenses equalling'$40,170.17, providing for a
balance of $7,253.83 to the end of the fiscal year if the $20,694 additional funds
is provided.
Please note, also, in,,letter from the Agency's Program Director, dated August 7, 1978,
the Agency has concurred with the $20,694 figure.
Management and Budget has not, to my knowledge, identified $20,694 in additional
funds to allocate to this Agency. The history of the Agency's account, related to
apparent commission intent, would cause it to be appropriate for an appropriation
ordinance to be created to allocate the $20,694 presuming identification of the funds
by Management and Budget.
