A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA,
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN
INTERLOCAL AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
BETWEEN THE CITY OF MIAMI ("CITY") AND THE VILLAGE OF KEY BISCAYNE
("VILLAGE") FOR THE JOINT PLANNING, DESIGN, CONSTRUCTION,
MAINTENANCE, AND USE OF A NEW ATHLETIC FIELD LOCATED ON VIRGINIA
KEY; FURTHER DIRECTING THE CITY MANAGER TO APPROPRIATE AND
ALLOCATE FUNDING, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FIFTY
THOUSAND DOLLARS ($150,000.00), FOR THE INITIAL CONSULTANT SERVICES
RELATED TO PLANNING AND DESIGN, FROM LEGALLY AVAILABLE FUNDING
SOURCES, SUBJECT TO AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL
AT TIME OF NEED; FURTHER AUTHORIZING THE CITY MANAGER TO
NEGOTIATE AND EXECUTE ANY AND ALL RELATED DOCUMENTS, INCLUDING
AMENDMENTS AND EXTENSIONS, AS MAY BE NECESSARY TO EFFECTUATE
THE PURPOSES OF THIS RESOLUTION, SUBJECT TO PRIOR ALLOCATION,
APPROPRIATION, AND BUDGETARY APPROVALS, AND COMPLIANCE WITH ALL
APPLICABLE LAWS, INCLUDING THE CITY'S PROCUREMENT ORDINANCE, THE
ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, AS SET FORTH
IN CHAPTER 18 OF THE CITY CODE.

THE PURPOSES OF THIS RESOLUTION, SUBJECT TO PRIOR ALLOCATION,

APPLICABLE LAWS, INCLUDING THE CITY'S PROCUREMENT ORDINANCE, THE
ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, AS SET FORTH
IN CHAPTER 18 OF THE CITY CODE.
WHEREAS, the City of Miami ("City") owns certain real property located at 3801
Rickenbacker Causeway on Virginia Key ("Virginia Key"); and
WHEREAS, there exists vacant land within Virginia Key, located east of the Miami -Dade
County Water and Sewer Department wastewater treatment facility and west of Arthur J. Lamb
Road, that may be suitable for recreational improvements, including the development of athletic
fields; and
WHEREAS, the Village of Key Biscayne ("Village") has proposed the formation of a joint
task force with the City to conduct a feasibility assessment of the site and proposed project,
prepare a conceptual design for an athletic field, and develop a basis -of -design document,
including a preliminary project cost estimate; and
WHEREAS, the Village has further proposed entering into a cooperative partnership with
the City through a formal interlocal agreement to provide for the joint planning, design,
construction, maintenance, and shared use of the proposed athletic field; and
WHEREAS, the Village has indicated its willingness to fund fifty percent (50%) of the
costs associated with the planning and design of the project and has begun reserving funds in
anticipation of the construction phase; and
WHEREAS, the City Commission finds that the development of an athletic field on
Virginia Key, in collaboration with the Village, would promote recreational opportunities,
enhance public use of City -owned property, and serve the best interests of the City and its
residents;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is hereby authorized' to negotiate and execute the
Interlocal Agreement, in a form acceptable to the City Attorney, for the joint planning, design,
construction, maintenance, and use of a new athletic field on Virginia Key.
Section 3. The City Manager is hereby directed to appropriate and allocate funding, in an
amount not to exceed One Hundred Fifty Thousand Dollars ($150,000.00), for the initial
consultant services related to planning and design, from legally available funding sources,
subject to availability of funds and budgetary approval at time of need;
Section 4. The City Manager is further authorized' to negotiate and execute all related
documents, including amendments and extensions, as may be necessary to carry out the intent
and purposes of this Resolution, provided that all required allocations, appropriations, and
budgetary approvals have been made and compliance with all applicable laws, including but not
limited to the City's Procurement Ordinance, the Anti -Deficiency Act, and the Financial Integrity
Principles set forth in Chapter 18 of the City Code.
Section 5. This Resolution shall become effective immediately upon its adoption.
