HomeMy WebLinkAboutR-26-0016City of Miami Resolution R-26-0016 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18622 Final Action Date: 1/8/2026 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BY A FOUR -FIFTHS (4/5THS) AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING, CONFIRMING, AND APPROVING THE CITY MANAGER'S RECOMMENDATION AND WRITTEN FINDINGS, ATTACHED AND INCORPORATED AS "EXHIBIT A," PURSUANT TO SECTION 18-85(A) OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("CITY CODE"); WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING METHODS AS NOT BEING PRACTICABLE OR ADVANTAGEOUS TO THE CITY OF MIAMI ("CITY") TO ESTABLISH A CONTRACT FOR THE PROVISION OF RESILIENCE DATA AND ENGAGEMENT SERVICES ("SERVICES") BY ISEECHANGE, INC. ("ISC") FOR THE CITY'S DEPARTMENT OF RESILIENCE AND PUBLIC WORKS ("RPW'), FOR A PERIOD OF ONE (1) YEAR WITH THE OPTION TO RENEW FOR THREE (3) ADDITIONAL ONE (1)- YEAR PERIODS, IN THE TOTAL ESTIMATED AMOUNT OF TWO HUNDRED TWENTY-THREE THOUSAND FIVE HUNDRED AND 00/100 DOLLARS ($223,500.00); ALLOCATING FUNDS FOR THIS PURPOSE FROM ACCOUNT NOS. 00001.208000.531000.00000, 00001.201200.531000.00000, OR OTHER LEGALLY AVAILABLE FUNDING SOURCES, SUBJECT TO THE AVAILABILITY OF FUNDS AND BUDGETARY APPROVAL AT THE TIME OF NEED; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH ISC FOR THE SERVICES CONSISTENT WITH THE TERMS SET FORTH HEREIN; FURTHER AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY DOCUMENTS, INCLUDING AMENDMENTS, RENEWALS, AND EXTENSIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY, AND SUBJECT TO ALL ALLOCATIONS, APPROPRIATIONS, AND PRIOR BUDGETARY APPROVALS, AND IN COMPLIANCE WITH APPLICABLE PROVISIONS OF THE CITY CODE, INCLUDING, THE CITY OF MIAMI'S PROCUREMENT ORDINANCE, ANTI -DEFICIENCY ACT, AND FINANCIAL INTEGRITY PRINCIPLES, ALL AS SET FORTH IN CHAPTER 18 OF THE CITY CODE, AND IN COMPLIANCE WITH ALL APPLICABLE LAWS, RULES, AND REGULATIONS, AS MAY BE DEEMED NECESSARY FOR SAID PURPOSE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, ISeeChange, Inc. ("ISC") provides a signature platform product for public sector agencies seeking to engage communities in real time regarding hyperlocal flooding, extreme heat, climate adaption, infrastructure and other resilience elements ("Services"); and HEREAS, ISC, with support of the Knight Foundation, created integrations and features for the City inclusive of custom mapping, email integrations, data exports, pathways to support municipal operations, flood modeling and infrastructure project design; and City of Miami Page 1 of 3 File ID: 18622 (Revision:) Printed On: 1/16/2026 File ID: 18622 Enactment Number: R-26-0016 WHEREAS, the City has used ISC to decrease response times during tropical storms, generate over $20,000,000.00 in resilience grant support, and coordinate/communicate direct services requests to clean and repair storm drains and deploy pumps.; and WHEREAS, pursuant to Section 18-85(a) of the Code of the City of Miami, as amended ("City Code"), the City Manager has recommended waiving the requirements for competitive sealed bidding methods, via recommendation and written finding attached and incorporated as Exhibit "A," with reasons supporting the same as not being practicable or advantageous to the City; and WHEREAS, said recommendation and written finding must be ratified, confirmed, and approved by the City Commission by a four -fifths (4/5ths) affirmative vote after an advertised public hearing; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the City Manager's recommendation and written findings, attached and incorporated as "Exhibit A," pursuant to Section 18-85 (a) of the Code of the City of Miami, Florida, as amended, waiving the requirements for competitive sealed bidding methods as not being practicable or advantageous to the City to establish a contract for the provision of the Services by ISC for RPW, for a period of one (1) year with the option to renew for three (3) additional one-year periods in a total estimated amount of Two Hundred Twenty -Three Thousand Five Hundred and 00/100 Dollars ($223,500.00), are ratified, confirmed, and approved, Section 3. Funds for this purpose are to be allocated from RPWs Account Nos. 00001.208000.531000.00000, 00001.201200.531000.00000, or other legally available funding sources, subject to the availability of funds and budgetary approval at the time of need. Section 4. The City Manager is authorized' to negotiate and execute an agreement, in a form acceptable to the City Attorney, with ISC for the Services consistent with the terms set forth herein. Section 5. The City Manager is further authorized' to negotiate and execute all other documents, including any amendments, renewals, and extensions, all in forms acceptable to the City Attorney, subject to allocations, appropriations and budgetary approval having been previously made, and in compliance with applicable provisions of the City Code, including, the City of Miami's Procurement Ordinance, Anti -deficiency Act, and Financial Integrity Principles, all as set forth in Chapter 18 of the City Code, and in compliance with applicable regulations, as may be necessary for said purpose. Section 6. This Resolution shall become effective immediately upon its adoption. 1 The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions.
