ENCLOSURES: Updated Legislation
The purpose of this Substitution Memorandum for Item PZ.12 on the November 20, 2025,
City Commission Agenda is to provide updated legislation. The updates are necessary to
Article 4 Table 4 for T5 and T6:
• Incorporate text to eliminate parking requirements for bonus units in the T5 and T6
Transect Zones, pursuant to the Planning, Zoning and Appeals Board ("PZAB")
recommendation.
• Clarify the recommendation made by the PZAB regarding the parking requirements
of bonus units.
Upon approval, the updated legislation for the above -referenced Miami 21 Text Amendment
will be provided to the City Clerk's Office for distribution to the Mayor and all
Commissioners.

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
ORDINANCE NO. 13114, THE ZONING ORDINANCE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"), SPECIFICALLY BY
AMENDING ARTICLE 4, TABLE 4, TITLED "DENSITY, INTENSITY AND
PARKING (T4)", "DENSITY, INTENSITY AND PARKING (T5)", AND
"DENSITY, INTENSITY AND PARKING (T6)," TO IMPLEMENT THE
DOUBLING OF DENSITY ALLOWED UNDER THE INTERPRETATION OF
THE FUTURE LAND USE MAP OF THE MIAMI COMPREHENSIVE
NEIGHBORHOOD PLAN; MAKING FINDINGS; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on
October 15, 2025, following an advertised public hearing, adopted Resolution No. PZAB-R-25-
071, by a vote of nine to two (9-2), recommended approval of the zoning text change, Item No.
PZAB.5; and
WHEREAS, on October 22, 2009, the Miami City Commission adopted Ordinance No.
13114 as the Zoning Ordinance of the City of Miami, Florida, which has been amended from
time to time ("Miami 21 Code"); and
WHEREAS, the Miami Comprehensive Neighborhood Plan ("MCNP") allows for density
increases by up to one hundred percent (100%) for various Future Land Use designations under
the Interpretation of the Future Land Use Map; and
WHEREAS, the implementation of said Density increases are deferred to the applicable
land development regulations in the Miami 21 Code; and
WHEREAS, the City of Miami ("City") has a known affordability crisis, and increasing the
supply of housing units will help stabilize rents through basic supply and demand economics;
and
WHEREAS, neighborhoods with some of the highest demand for residential
development have Future Land Use designations that allow Density increases by up to one
hundred percent (100%); and
WHEREAS, some of these neighborhoods are also located in the Coastal High Hazard
Area ("CHHA") or Miami -Dade County's Storm Surge Planning Zone's A, B, or C; and
WHEREAS, Policy CM-4.1.2 of the MCNP is meant to mitigate against the potentially
adverse effects of the CHHA; and

WHEREAS, the City has created a Resilience Trust Fund within Chapter 62 of the Code
of the City of Miami, intended to focus and dedicate funding to infrastructure development for
neighborhoods vulnerable to the effects of climate change and sea level rise; and
WHEREAS, residential development at increased density in high -demand, high density
residential areas, which tend to be located within the CHHA or Storm Surge Planning Zones A,
B, or C, paired with a contribution into the Resilience Trust Fund will mitigate against potentially
adverse impacts of developing in these areas; and
WHEREAS, consideration has been given as to whether the proposed text amendment
will further the goals, objectives, and policies of the MCNP, the Miami 21 Code, and other City
regulations; and
WHEREAS, consideration has been given as the need and justification for the proposed
text amendment, including changed or changing conditions, that make the passage of the
proposed text amendment necessary; and
WHEREAS, the City Commission approves this ordinance with the modification that for
T5 and T6 Transect Zones utilizing this Resilience Trust Fund program, there be no parking
mandates for one hundred percent (100%) of the bonus density achieved through the program
and that parking requirements only apply to the base density units;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as if fully set forth in this Section.
Section 2. The City Commission approves that the Miami 21 Code be amended by
revising Article 4, Table 4, in the following particulars:1

AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 13114, THE
ZONING ORDINANCE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED ("MIAMI 21 CODE"),
SPECIFICALLY BY AMENDING ARTICLE 4, TABLE 4, TITLED "DENSITY, INTENSITY AND PARKING
(T4)", "DENSITY, INTENSITY AND PARKING (T5)", AND"DENSITY, INTENSITY AND PARKING (T6),"
TO IMPLEMENT THE DOUBLING OF DENSITY ALLOWED UNDER THE INTERPRETATION OF THE
FUTURE LAND USE MAP OF THE MIAMI COMPREHENSIVE NEIGHBORHOOD PLAN; MAKING
FINDINGS; CONTAINING A SEVERABILITY CLAUSE; AND PROVIDING FOR AN IMMEDIATE
EFFECTIVE DATE.
WHEREAS, the Planning, Zoning and Appeals Board ("PZAB"), at its meeting on October 15, 2025,
following an advertised public hearing, adopted Resolution No. PZAB-R-25-071, by a vote of nine to two (9-
2), recommended approval of the zoning text change with the modification that for T5 and T6 Transect Zones
utilizing this Resilience Trust Fund program, there be no parking mandates for one hundred percent (100%) of
the bonus density achieved through the program and that parking requirements only apply to the base density
units, Item No. PZAB.5; and
WHEREAS, on October 22, 2009, the Miami City Commission adopted Ordinance No. 13114 as the
Zoning Ordinance of the City of Miami, Florida, which has been amended from time to time ("Miami 21 Code");
and
WHEREAS, the Miami Comprehensive Neighborhood Plan ("MCNP") allows for density increases by
up to one hundred percent (100%) for various Future Land Use designations under the Interpretation of the
Future Land Use Map; and
WHEREAS, the implementation of said Density increases are deferred to the applicable land
development regulations in the Miami 21 Code; and
WHEREAS, the City of Miami ("City") has a known affordability crisis, and increasing the supply of
housing units will help stabilize rents through basic supply and demand economics; and
WHEREAS, neighborhoods with some of the highest demand for residential development have Future
Land Use designations that allow Density increases by up to one hundred percent (100%); and
WHEREAS, some of these neighborhoods are also located in the Coastal High Hazard Area ("CHHA")
or Miami -Dade County's Storm Surge Planning Zone's A, B, or C; and
WHEREAS, Policy CM-4.1.2 of the MCNP is meant to mitigate against the potentially adverse effects of
the CHHA; and
WHEREAS, the City's Climate Resilience Committee reviewed and discussed this legislation at their
meeting on November 10, 2025; and
WHEREAS, the City has created a Resilience Trust Fund within Chapter 62 of the Code of the City of
Miami, intended to focus and dedicate funding to infrastructure development for neighborhoods vulnerable to
the effects of climate change and sea level rise; and
WHEREAS, residential development at increased density in high -demand, high density residential
areas, which tend to be located within the CHHA or Storm Surge Planning Zones A, B, or C, paired with a
contribution into the Resilience Trust Fund will mitigate against potentially adverse impacts of developing in
these areas; and

WHEREAS, consideration has been given as to whether the proposed text amendment will further the
goals, objectives, and policies of the MCNP, the Miami 21 Code, and other City regulations; and
WHEREAS, consideration has been given as the need and justification for the proposed text
amendment, including changed or changing conditions, that make the passage of the proposed text
amendment necessary; and
WHEREAS, the City Commission approves this ordinance with the modification that for T5 and T6
Transect Zones utilizing this Resilience Trust Fund program, there be no parking mandates for one hundred
percent (100%) of the bonus density achieved through the program and that parking requirements only apply
to the base density units;

Section 4. It is the intention that the provisions of this Ordinance shall become and be made a part of
the Zoning Ordinance of the City of Miami, Florida, which provisions may be re -numbered or re -lettered and
that the word "ordinance" may be changed to "section", "article", or other appropriate word to accomplish such

Section 5. If any section, part of a section, paragraph, clause, phrase, or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective ten (10) days upon adoption2.
