AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
18/ARTICLE VIII OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), TITLED "FINANCE/STORMWATER UTILITIES," BY
AMENDING SECTION 18-294, TITLED "SCHEDULE OF RATES," TO SET THE
STORMWATER MANAGEMENT RATES; CONTAINING A SEVERABILITY
CLAUSE; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE
WHEREAS, Chapter 18, Article VIII, of the Code of the City of Miami, Florida, as
amended ("City Code"), authorizes the implementation of stormwater utility fees; and
WHEREAS, the City of Miami ("City") recognizes the importance of maintaining a clear
and transparent framework for the administration of stormwater management services to ensure
effective environmental stewardship and infrastructure sustainability; and
WHEREAS, stormwater runoff generated from impervious surfaces limits the percolation
of water into the natural ground, resulting in excess water that requires specialized infrastructure
to allow for the drainage of excess water; and
WHEREAS, Section 18-294 of the City Code currently outlines provisions related to
stormwater management for residential and non-residential properties; and
WHEREAS, the stormwater utility fees are currently $3.50 per month and have remained
the same since 1998; and
WHEREAS, the stormwater utility fees are necessary for the planning, construction,
operation and maintenance of stormwater management system, including reduction of
pollutants and contaminants found in stormwater; and
WHEREAS, Resolution R-23-0181 required that the City's Stormwater system
maintenance cycle be increased; and
WHEREAS, Resolution R-24-0102 adopted the City's Stormwater Master Plan with a
capital cost estimated in 2021 to be $5,392,000,000 to achieve a 10-year level of service and
$3,820,000,000 to achieve a 5-year level of service; and
WHEREAS, the City Commission finds it necessary to amend Section 18-294 to set the
schedule of rates for stormwater management services and improvements, thereby promoting
administrative efficiency and fiscal responsibility; and
WHEREAS, it is in the best interest of the City and the community to allow for these
standardized requirements;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 18 of the City Code is amended in the following particulars:1
"CHAPTER 18.
FINANCE
ARTICLE VIII. — STORMWATER UTILITY FEES
Sec. 18-294. - Schedule of rates.
The department of resilience and public works with the approval of the city manager
shall establish the following base ratcs as neccssary to reasonably cover the cost of providing
such serviccs which are on file in the department of resilience and public works:
(1) The rates to be charged for stormwater management for each residence or dwelling
unit shall be the current base rate per month in the amount of $7.00.
(2) The rates to be charged for nonresidential properties, i.e., all occupancies other than
provided for in subsection (1) of this section, shall be the rate established in
subsection (1) (the current base rate per month) multiplied by the number of
equivalent residential units. The number of equivalent residential units equals the
total square footage of impervious area of the property divided by 1,191 square feet
(statistically developed average for a residence in the city). Equivalent residential
units will be rounded to the nearest tenth of a unit. A minimum charge based on one-
half of one equivalent residential unit (0.5 ERU) will be assigned to any property
calculated to be less than 0.5 ERU.
The base rate per month shall increase each year by $0.50 and shall be reviewed every five (5)
years by the Department of Resilience and Public Works, providing a report to the City Manager
to determine if any revision of the base rate per month is appropriate.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provision of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective immediately after final reading and
adoption thereof.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
