AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER
62/ARTICLE II OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED ("CITY CODE"), TITLED "PLANNING AND
ZONING/COMPREHENSIVE PLANNING," MORE PARTICULARLY BY
AMENDING SECTION 62-12 OF THE CITY CODE, TITLED "FEE FOR
INSPECTIONS AND EXAMINATIONS OF PLANS FOR COMPLIANCE WITH
THE PROVISIONS OF THE CITY ZONING ORDINANCE," TO UPDATE THE
ZONING PLAN REVIEWS FEE; CONTAINING A SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami ("City") wishes to clarify fees and make necessary
adjustments to the fees relating to permits provided pursuant to Ordinance No. 13114, the
Zoning Ordinance of the City of Miami, Florida, as amended ("Miami 21 Code"); and
WHEREAS, the City wishes to have expenses incurred by permit applications covered
by fees paid by applicants rather than being subsidized by the City's general fund; and
WHEREAS, an analysis was conducted to determine how much time City staff spend on
their various duties; and
WHEREAS, the proposed fee updates to Chapter 62, Section 62-12 of the Code of the
City of Miami, Florida, as amended ("City Code"), clarify the zoning review fees and ensure that
the City's service costs are not subsidized by the general public and have been adjusted to
more closely align with actual cost recovery; and
WHEREAS, on October 8, 2025, at a duly notice public meeting, the Planning, Zoning
and Appeals Board ("PZAB") considered this text amendment to Chapter 62 of the City Code,
Item PZAB.10, and passed PZAB-R-25-062, recommending approval, by a vote of eight to zero
(8-0); and
WHEREAS, these fees are charged in exchange for a particular governmental service;
the services benefit the party paying the fee in a manner not shared by other members of
society; and the fees are paid by choice, in that the party paying the fee has the option of not
utilizing the governmental service and thereby avoiding the charge; and
WHEREAS, it has been determined that the updates are fair and reasonable;
commensurate to the services provided; and essential for the continued provision of high -quality
services focusing on the public's health, safety and welfare; and
WHEREAS, the City is committed to a yearly review of these fees so that fee
adjustments are made for services, if necessary, and that fees are calibrated to more closely

recover costs; and
WHEREAS, it is necessary to make all fees within Chapter 62 of the City Code
comprehensive and consistent so there are no conflicts with any other provisions of the City
Code or the Miami 21 Code; and
WHEREAS, the City Commission finds it necessary and in the best interest of the City
and its residents to amend Chapter 62 as indicated herein;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. Chapter 62 of the City Code shall be amended in the following particulars:1
"CHAPTER 62
PLANNING AND ZONING
ARTICLE II
COMPREHENSIVE PLANNING
Section 62-12. — Fee for inspections and examinations of plans for compliance with the
provisions of the city zoning ordinance.
There is hereby established the following fee per square foot of total land area encompa-sed in
the project the building to be charged at the time the application is made for the construction of
a new building, change of use of building, or an addition (proportional part of land area), for the
purpose of examination of the plans and site development and subsequent inspections of the
building site prior to the issuance of the certificate of occupancy and subsequent thereto to
assure original and continued compliance with the provisions of the city zoning ordinance:
Single-family and duplexes: $0.20 per square foot with a minimum of $100.00.
All other uses: $0.16 per square foot of the building with a minimum of $200.00$300.00
This fee shall be in addition to the building permit fee.

Section 3. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective ten (10) days upon adoption by the
City Commission.2

2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10)
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date stated
herein, whichever is later.
