PLEASE ATTACH THIS ROUTING FORM TO ALL DOCUMENTS THAT REQUIRE EXECUTION BY THE CITY MANAGER LETTER OF AGREEMENT Between the City of Miami and the Miami -Dade Sheriff's Office Regarding the Cold Case Grant Crime Laboratory Collaboration Effective Date: October 1, 2024 Expiration Date: September 30, 2027 PARTIES: This Letter of Agreement is entered into by and between the City of Miami (City), through its Miami Police Department (MPD), located at 400 N.W. 2nd Avenue, and the Miami -Dade Sheriff's Office (MDSO), located at 9105 NW 25th Street. BACKGROUND: The City, through the MPD, received a grant award from the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, in the amount of $500,000.00, with no required local match. The purpose of the grant is to provide funding to support the prosecution of violent cold case crimes where a suspect (known or unknown) has been identified through DNA evidence. Grant funds can also be used to support investigative activities, and forensic analyses, that could lead to the successful prosecution of violent cold case crimes where a DNA profile attributed to a known or unknown suspect has been developed from crime scene evidence. The MPD has a backlog of approximately 1,932 open cold cases dating from 1949-2024. The MPD will collaborate with the Miami -Dade State Attorney's Office and the MDSO to compile a list of qualifying unresolved cold case crimes that already have a DNA profile. The MPD will subaward grant funds to the MDSO to support personnel overtime. SCOPE OF WORK: For the duration of the grant period, the MPD and the MDSO agree to following activities: 1. Cold Case Review and Inventory: • The MPD will inventory all unresolved violent cold case crimes within its jurisdiction that already have a suspect DNA profile developed. • Before the end of the grant period, the MPD will enter all qualifying cases into the Violent Criminal Apprehension Program (ViCAP), a unit of the Federal Bureau of Investigations (FBI) responsible for the analysis of serial violent and sexual crimes, to increase the chances of identifying and apprehending violent perpetrators who pose a serious threat to public safety. • The MPD will enter all applicable cases, if any, into the National Missing and Unidentified Persons System (NamUS) program, a national centralized repository and resource center for locating missing persons, identifying unidentified human remains, and repatriating unclaimed persons. • The MPD will provide MDSO with its inventory of qualifying unresolved violent cold case crimes. • The MPD will utilize MDSO's Crime Laboratory DNA reports where DNA profiles have already been developed to complete a certified inventory of qualifying unresolved violent cold case crimes under MPD's jurisdiction. • The Parties will provide the certified inventory of qualifying unresolved cold case crimes to law enforcement to support investigative activities that could lead to the successful prosecution of violent cold case crimes. 2. Crime Laboratory and Personnel: • The MDSO Crime Laboratory will allocate the following personnel to support the project: o CODIS Administrator(s) (Criminalist II) o Police Crime Scene Technician(s) o Criminalist(s) II to provide forensic services for qualifying cold case investigations, in accordance with grant guidelines. o Personnel will assist in evidence processing, forensic analysis, and DNA testing for qualifying cases. 3. Grant Funding and Reimbursement: • Over the course of the grant period, the City of Miami will subaward awarded grant funds in an amount not to exceed $78,644 to the MDSO Crime Laboratory to cover overtime expenses of the designated personnel. • MDSO will submit detailed invoices and timesheets reflecting the overtime hours worked on grant -related activities. • The City of Miami will review and process payments in accordance with the grant terms and conditions. REPORTING AND COMPLIANCE: • Both Parties agree to maintain accurate records and provide periodic reports as required by the grant. • The MDSO will comply with all applicable federal, state, and local regulations governing the use of grant funds. • Any modifications to the scope of work or budget must be agreed upon in writing by both Parties. TERM AND TERMINATION: • This Agreement will remain in effect from October 1, 2024, through September 30, 2027, unless terminated earlier by mutual written consent. • Either Party may terminate this Agreement with 30 days' written notice. • In the event of termination, both Parties agree to cooperate in finalizing outstanding activities and financial obligations. "Assume Responsibility" shall mean incurring any and all costs associated with any suit, claim, action, or claim for damages arising from the performance of this Agreement.
