Biscayne Boulevard, Suite 300 Miami, FL 33131 PARTIAL RELEASE OF MORTGAGE KNOWN ALL MEN BY THESE PRESENTS: WHEREAS, Omni Redevelopment District Community Redevelopment Agency, hereinafter called "the Mortgagee", being the Mortgagee by that certain Mortgage and Security Agreement for Rehabilitation Project at 2003 N Miami Avenue, Miami, Florida in favor of Kush Property, LLC, hereinafter called "the Mortgagor", dated December 18, 2024 and recorded December 24, 2024 in Official Records Book 34548, Page 4736 of the Public Records of Miami -Dade County, Florida (hereinafter called the "Mortgage"), securing that certain Promissory Note in the principal sum of THREE MILLION ONE HUNDRED THOUSAND AND NO/100 Dollars (US$3,100,000.00), which Mortgage encumbers certain property located in Miami - Dade County, Florida, being more particularly described therein, AND WHEREAS, the said Mortgagor has requested the Mortgagee to release the premises hereinafter described, being part of the mortgaged premises, from the lien and operation of the Mortgage; NOW THEREFORE, the Mortgagee, for and in consideration of the sum often Dollars ($10.00), paid by the Mortgagor at the time of the execution hereof, the receipt and sufficiency of which is hereby acknowledged, does hereby remise, release, quit -claim, exonerate and discharge from the lien and operation of the Mortgage unto the Mortgagor, their heirs and assigns, all that piece, parcel, or tract of land, being a part of the premises conveyed by the said Mortgage, to -wit: (See Exhibit "A") TO HAVE AND TO HOLD the same, with the acceptances, unto the said Mortgagor, its heirs and assigns forever, freed, exonerated and discharged of and from the lien of said mortgage and every part thereof; provided always, nevertheless, that nothing herein contained shall in anyways impair, alter or diminish the effect, lien or encumbrance of the aforesaid Mortgage, on the remaining part of the said mortgaged premises not hereby released there from, or any of the rights and remedies contained therein.
