A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A MASTER
JOINT USE AGREEMENT ("JUA") WITH THE SCHOOL BOARD OF MIAMI-DADE
COUNTY, FLORIDA ("SCHOOL BOARD"), WITH A TERM OF FORTY (40) YEARS, IN
SUBSTANTIALLY THE FORM ATTACHED, AND ACCEPTABLE TO THE CITY
ATTORNEY, SUBJECT TO THE SCHOOL BOARD'S APPROVAL OF THE JUA IN
FINAL FORM, TO GOVERN THE USE OF ANY AND ALL CITY OF MIAMI PARKS IN
ORDER TO EXPAND PUBLIC ACCESS TO RECREATIONAL SPACES AT VARIOUS
PUBLIC SCHOOLS LOCATED THROUGHOUT THE CITY OF MIAMI DURING NON -
SCHOOL HOURS; FURTHER AUTHORIZING THE CITY MANAGER TO REMOVE OR
ADD CITY PARKS DURING THE TERM OF THE JUA AND EXECUTE ANY AND ALL
DOCUMENTS NECESSARY, INCLUDING BUT NOT LIMITED TO, AMENDMENTS,
MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY AND
SCHOOL BOARD FOR SAID PURPOSE.

MODIFICATIONS, ALL IN FORMS ACCEPTABLE TO THE CITY ATTORNEY AND
SCHOOL BOARD FOR SAID PURPOSE.
WHEREAS, pursuant to City of Miami ("City") Resolution R-25-0256, the City
Commission expressed its desire to expand public access to recreational spaces in the City;
and
WHEREAS, The School Board of Miami -Dade County, Florida ("Board") and City
(collectively, "Parties") are mutually interested in and concerned with providing and making
recreational programs, activities and facilities available for the use and benefit of the students of
Miami -Dade County Public Schools and the residents of the City; and
WHEREAS, the Board owns and has under its jurisdiction certain real property which is
used by the Board for administrative, recreational, and educational purposes ("School Sites"),
and the City owns and has under its jurisdiction certain real property which is used by the City
for public park purposes ("Park Sites"); and
WHEREAS, the Parties are desirous of entering into a Master Joint Use Agreement
("JUA") to allow designated Park Sites and designated School Sites located within the City's
geographic boundaries to be made available to both Parties for recreational programs, activities,
and functions, under terms and conditions outlined within the JUA; and
WHEREAS, the City Commission finds that entering into a JUA with the Board is in the
best interests and welfare of the residents of the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to negotiate and execute a Master Joint Use
Agreement ("JUA") between the City and the School Board, in substantially the form attached
form, and acceptable to the City Attorney, intended to govern the use of all City Parks, as may
be amended from time to time, for a term of forty (40) years.
Section 3. Execution and implementation of the JUA is subject to review and approval of
the JUA in final form by the School Board at a regularly scheduled School Board meeting.
Section 4. The City Manager is further authorized' to add or remove City Park Sites and
School Sites from the JUA during the term of the JUA, in a from acceptable to the City Attorney
and School Board.
Section 5. This Resolution shall become effective immediately upon its adoption.

the City Attorney including but not limited to those prescribed by applicable City Charter and City Code
provisions.
