A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
PURSUANT TO SECTION 29-B(E) AND SECTION 29-B(F) OF THE CHARTER
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, APPROVING THE
DONATION OF A CITY OF MIAMI ("CITY") OWNED CLUC 90 LAND LOCATED
ADJACENT TO 1483 NORTHWEST 7 AVENUE, MIAMI, FLORIDA AND
IDENTIFIED AS FOLIO NUMBER 01-3136-041-0011, TO CAMILLUS HOUSE,
INC., A FLORIDA NOT FOR PROFIT CORPORATION ("DONEE"); FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE A QUITCLAIM DEED
("DEED") AND SUCH OTHER DOCUMENTS AND AMENDMENTS AS MAY BE
NECESSARY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO
EFFECTUATE SUCH DONATION IN ACCORDANCE WITH TERMS AND
CONDITIONS OF THE DEED.

WHEREAS, the City of Miami ("City") is the fee simple owner of that certain property
identified with Folio number 01-3136-041-0011, Miami, Florida ("Property"); and
WHEREAS, Camillus House, Inc., a Florida Not For Profit Corporation ("Donee") is
interested in the Property for the purpose of reducing the City's homeless population and
provide supportive housing for formerly homeless individuals who have been successfully
treated with Behavioral Health programs ("Intended Purpose"); and
WHEREAS, currently, the Property sits vacant, represents a maintenance cost and
liability to the City, and does not generate ad valorem taxes; and
WHEREAS, Section 29-B(e) of the Charter of the City of Miami, Florida, as amended
("City Charter"), provides that the requirements for competitive bidding shall not apply when
disposing of property acquired in connection with delinquent taxes which properties were
conveyed to the City by the Board of County Commissioners of Miami -Dade County under the
provisions of Section 197.592(3) Florida Statutes, as amended; and
WHEREAS, the Property was conveyed from Miami -Dade County to the City, for no
consideration and in accordance with Florida Statute 197.592(3); and
WHEREAS, Section 29-B(f) of the City Charter, provides an exception from the
competitive bidding requirements for disposition of non -waterfront City -owned property when
conveying to an adjacent property owner, the subject property is 7,500 square feet or less, or
the subject non -waterfront property is non -buildable; and
WHEREAS, the area contained in the Property is not in excess of 7,500 square feet, is
non -buildable, non -waterfront, and its conveyance to the adjacent property owner would assist
in providing for the assemblage of land by the Donee; and

WHEREAS, if the Property or any portion thereof ceases to be used for the Intended
Purpose, all rights and title to the property, or the disused portion thereof, shall revert to the City
automatically; and
WHEREAS, the Property will be conveyed "as is" and "where is," absent any warrant for
sufficiency of its title nor any interest it may have in the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Deed and such other
documents and amendments as may be necessary, to effectuate such donation in accordance
with terms and conditions of the Deed for the donation of the Property to the Donee, for the
Intended Purpose, all in a forms acceptable to the City Attorney.
Section 3. Pursuant to Sections 29-B(e) and 29-B(f) of the City Charter, the City
Manager is hereby authorized to execute the Deed.
Section 4. The City does not warrant the sufficiency of its title nor any interest it may
have in the Property, nor does it make any covenant whatsoever as to the Property, which is
being conveyed to the Donee "as is" and "where is" and which the Property is accepted by the
Donee "as is" and "where is" as to all conditions.
Section 5. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may be
imposed, including but not limited to, those prescribed by applicable City Charter and City Code
provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
