Background of Item: The Florida Department of Transportation ("Department") has jurisdiction over State Road (SR) 5 (US-1) (Biscayne Boulevard) from NE 14th Street to NE 15th Street, which is located within the limits of the City. Pursuant to Permit Number 2025-K-690-00033 and 2024-L-690-00004, the City required the developer to draft design plans for landscape, irrigation, pavers, tree grate and lighting on State Road (SR) 5 (US-1) (Biscayne Boulevard) from NE 14th Street to NE 15th Street. The project limits, as described in Exhibit "A" attached hereto, will be on State Road (SR) 5 (US-1) (Biscayne Boulevard) from NE 14th Street to NE 15th Street. Within these limits, the developer will install landscape, irrigation, pavers, tree grate and lighting improvements along SR-5, inside the Department's Right -of -Way, in accordance with Permit Number 2025-K-690- 00033 and 2024-L-690-00004 (the "Project"). The developer is required to execute a Non -Standard Improvement (NSI) Covenant with the City for the landscape, irrigation, pavers, tree grate and lighting improvements included in the MMOA. It is the intent of the parties for this agreement supplements all existing Maintenance Memorandum of Agreement and permits previously executed between the Department and the City. The parties mutually recognize the need to enter into an agreement designating and setting forth the City's responsibilities regarding the maintenance of the landscape, irrigation, pavers, tree grate and lighting improvements, and all associated features (the improvements) within the project limits. WHEREAS, the Florida Department of Transportation ("FDOT") has jurisdiction over State Road 5 ("SR-5") / United States Route 1 ("US-1 ") / Biscayne Boulevard from Northeast 14 Street to Northeast 15 Street, which is located within the limits of the City of Miami ("City"); and WHEREAS, PRH 1400 Biscayne 1, LLC ("Developer"), pursuant to Permit Nos. 2025-K- 690-00033 and 2024-L-690-00004, has drafted design plans for landscape, irrigation, pavers, tree grate and lighting improvements ("Project"), as approved by FDOT, along SR-5 / US-1 / Biscayne Boulevard from Northeast 14 Street to Northeast 15 Street, the limits of which are described in Exhibit "A" of the attached and incorporated Landscape, Irrigation, Pavers and Specialty Surfaces Maintenance Memorandum of Agreement ("MMOA") ("Project Limits"); and WHEREAS, the Developer will install landscape, irrigation, and tree grates in accordance with the design plans for Permit Nos. 2025-K-690-00033 and 2024-L-690-00004 ("Project"), as approved by FDOT; and WHEREAS, the City is aware this MMOA will supplement all maintenance requirements between FDOT and the City for all previously executed Permits and Agreements; and WHEREAS, the City has made the Developer responsible for the operation, maintenance and liability of the Project via the execution of a non-standard improvement covenant; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized' to execute the MMOA, in substantially the attached form, with FDOT, to facilitate the installation and maintenance of the Project within the Project Limits. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
