Purpose:
To establish a clear and transparent process for evaluating and granting reasonable
accommodations. The process will promote compliance with applicable law, reduce barriers to
housing opportunities, and safeguard the rights of persons with disabilities.
Estimated Direct Economic Impact:
• There are no direct compliance costs that businesses will incur if the ordinance is enacted.
• There are no new fees associated with the amendment.
• The municipality's regulatory costs for enacting this amendment are unknown; however,
there will be no new revenues, charges or fees that will be imposed on businesses.
Estimated Number of Businesses to be Impacted:
It is anticipated that no business will be affected by this ordinance as it will primarily be utilized by
residences.
Additional Information:
• Federal and State Fair Housing laws, including the Fair Housing Amendments Act of 1988 and
the Americans with Disabilities Act, require local governments to provide reasonable
accommodations in zoning and land use regulations to ensure equal housing opportunities for
individuals with disabilities.
• Floridia Senate Bill 954 requires local governments to adopt an ordinance by January 1, 2026
to formalize and streamline the process for applicants seeking reasonable accommodations
from land use regulations in order to open a certified recovery residence.
