FOR AN EFFECTIVE DATE.
APPLICANT(S): Arthur Noriega V, City Manager on behalf of the City of Miami
PURPOSE: To introduce new zoning regulations that promote housing affordability,
urban mobility, and streamlined development processes through the integration of Micro
Dwelling Units and Lodging Liner Units into the City of Miami's urban fabric. This
amendment updates Article 4, Table 4, and Article 6, Section 6.1, Table 13 of the Miami
21 Code to clarify parking standards and allow micro dwelling units by right in
designated areas, specifically located in "T5" Urban Center and "T6" Urban Core
Transect Zones, and within:
• Transit -Oriented Development (TOD) areas
• Transit Station Neighborhood Districts (TSND)
• Neighborhood Revitalization Districts (NRDs)
• Proximity to universities or colleges
• Podium liner configurations
This amendment emphasizes the integration of compact, affordable housing options
into new, expanding, or redeveloping neighborhoods, while supporting transit access,
walkability, and sustainable urban growth. It also introduces criteria for streamlining
regulatory processes and encouraging development aligned with the City's resilience
and equity goals.

WHEREAS, on October 22, 2009, the Miami City Commission adopted Ordinance No.
13114 as the Zoning Ordinance of the City of Miami, Florida, which has been amended from
time to time ("Miami 21 Code"); and
WHEREAS, the Office of the City Manager appointed a Steering Committee to evaluate
existing Miami 21 Code Entitlements with the intent of identifying opportunities for process
improvements and recommending legislative amendments ("Entitlement Reform Program"); and
WHEREAS, Article 1, Section 1.2 of the Miami 21 Code defines Micro Dwelling Units as
a small Multi -Family Residential Dwelling Unit type that shall include sanitary facilities and
kitchen facilities; and
WHEREAS, Article 6, Table 13 of the Miami 21 Code includes provisions for Micro
Dwelling Units, establishing a minimum unit size of 275 square feet, and outlining conditions
under which they may be permitted; and
WHEREAS, the City of Miami ("City") seeks to promote Housing Affordability, urban
density, and Transit -Oriented Development ("TOD") in alignment with the goals of the Miami 21
Code; and

WHEREAS, Micro Dwelling Units are permitted by Right when fully contained within a
Podium Liner and not Abutting a T3 Transect Zone; and
WHEREAS, currently, Micro Dwelling Units may be allowed by process of Warrant within
the "T5-L," "T5-O," Urban Center Transect Zone(s) - Limited and Open and all "T6" Urban Core
Transect Zone when also located within a Transit -Oriented Development (TOD) areas and/or
Neighborhood Revitalization District-1 (NRD-1); and
WHEREAS, this amendment to the Miami 21 Code clarifies and expands locations and
conditions under which Micro Dwelling Units may be permitted by Right when specified criteria
is complied with; and
WHEREAS, an amendment is required to clarify parking requirements standards relating
to Micro Dwelling Units and Lodging Liner Units; and
WHEREAS, the Miami Comprehensive Neighborhood Plan ("MCNP") promotes the
creation of vibrant, pedestrian -friendly, and economically resilient urban environments through
policies that encourage mixed -use development, active ground -floor uses, and enhancement of
the public realm; and
WHEREAS, on October 8, 2025, at a duly notice public meeting, the Planning, Zoning
and Appeals Board ("PZAB") considered this text amendment to the Miami 21 Code, Item
PZAB.16, and passed PZAB-R-25-066, recommending approval, by a vote of eight to zero (8-
0); and
WHEREAS, consideration has been given as to whether the proposed text amendment
will further the goals, objectives, and policies of the Miami Comprehensive Neighborhood Plan
("MCNP"), the Miami 21 Code, and other City regulations; and
WHEREAS, consideration has been given as the need and justification for the proposed
text amendment, including changed or changing conditions, that make the passage of the
proposed text amendment necessary; and
WHEREAS, this amendment to the Miami 21 Code is found to be in the best interest of
the City and its residents;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are
adopted and incorporated as if fully set forth in this Section.

Section 4. If any section, part of a section, paragraph, clause, phrase, or word of this
Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 5. It is the intention of the City Commission that the provisions of this Ordinance
shall become and be made a part of the Zoning Ordinance of the City of Miami, Florida, which
provisions may be renumbered or relettered and that the word "ordinance" may be changed to
"section", "article", or other appropriate word to accomplish such intention.
