A RESOLUTION OF THE MIAMI CITY COMMISSION ISSUING A NOISE WAIVER
PURSUANT TO SECTIONS 36-4(A) AND (C) OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, AS AMENDED ("CITY CODE"), TITLED "NOISE/OPERATION OF RADIOS,
PHONOGRAPHS OR OTHER SOUND -MAKING DEVICES; BANDS, ORCHESTRAS
AND MUSICIANS —GENERALLY; EXEMPTION," AND SECTION 36-5(A) AND (C) OF
THE CITY CODE, TITLED "NOISE/SAME — HOURS OF OPERATION OF
JUKEBOXES, RADIOS, ETC.; EXEMPTION FOR EVENT ON CITY -OWNED
PROPERTIES; RELAXATION," FOR ART BASEL EVENTS, DECEMBER 4 THROUGH
6, 2025, AND NEW YEAR'S EVE EVENTS, DECEMBER 30 THROUGH 31, 2025, FOR
THE PROPERTY LOCATED AT 300 NORTHEAST 71 STREET, MIAMI, FLORIDA.
WHEREAS, Section 36-4(a) of the Code of the City of Miami, Florida, as amended,
("City Code") prohibits excessive noise or music audible at a distance of one hundred (100) feet
from a building or structure or vehicles from where it is produced; and
WHEREAS, Section 36-4(c)(1) of the City Code provides that the City Commission may
declare an exemption from Section 36-4(a) for special occasions by Resolution; and
WHEREAS, Section 36-5(a) of the City Code limits noise disturbances to those in
repose from the hours of 11:00 pm to 7:00 am; and
WHEREAS, Section 36-5(c) provides that the City Commission may declare an
exemption from section 36-5(a) for special occasions by Resolution; and
WHEREAS, Art Basel and Miami Art Week is a premiere art show known around the
world and is held every year in South Florida; and
WHEREAS, Art Basel and Miami Art Week will be held from December 4, 2025, through
December 6, 2025; and
WHEREAS, as usual, the New Year's Eve holidays are celebrated from December 30,
2025, through December 31, 2025; and
WHEREAS, Little River Studios ("Event Holder") will be hosting concert events for both
occasion on the above listed dates at 300 Northeast 71 Street, Miami, Florida ("Event Site");
and
WHEREAS, all other requirements of the City Code such as building, special event
permitting and other code matters are still required to be met; and
WHEREAS, the cutoff time for each Event at the Event Site is 3:00 am the following
morning;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The noise prohibition contained in Section 36-4(a) of the City Code is waived
pursuant to Section 36-4(c)(1) of the City Code entitled "Operation of radios, phonographs or
other sound -making devices; bands, orchestras and musicians —Generally; exemption" for Art
Basel Events and New Year's Eve celebration events to be hosted by the Event Holder at the
Event Site from December 4 through 6, 2025 and December 30 through 31, 2025
Section 3. The noise prohibition contained in Section 36-5(a) of the City Code is waived
pursuant to Section 36-5(b) of the City Code entitled "Same — Hours of operation of jukeboxes,
radios, etc.; exemption for events of City -owned property; relaxation " for Art Basel Events and
New Year's Eve celebration events to be hosted by the Event Holder at the Event Site from
December 4 through 6, 2025 and December 30 through 31, 2025.
Section 4. The Event Site and Event Holder must comply with all other requirements of
the State, Local and City law including building and special event permitting.
Section 5. The Event at the Event Site shall end at 3:00 am the following morning.
Section 6. Any violation of this Waiver or the requirement of State, Local and City law
shall result in a revocation of any permitting issued and cancellation of the Event.
Section 7. This Resolution shall become effective immediately upon its adoption.
