A RESOLUTION OF THE MIAMI CITY COMMISSION EXTENDING THE NRD-
1/WYNWOOD BID NOISE PILOT PROGRAM, PURSUANT TO ORDINANCE
NUMBER 14330 FOR CHAPTER 36/SECTION 36-4 OF THE CODE OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "NOISE/OPERATION OF
RADIOS, PHONOGRAPHS, OR OTHER SOUND -MAKING DEVICES; BANDS,
ORCHESTRAS, AND MUSICIANS — GENERALLY," AND CHAPTER
36/SECTION 36-5 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, TITLED "NOISE/SAME — HOURS OF OPERATION OF
JUKEBOXES, RADIOS, ETC.; EXEMPTION FOR EVENTS ON CITY -OWNED
PROPERTY; RELAXATION," FOR AN ADDITIONAL YEAR; CONTAINING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, pursuant to Ordinance No. 14330, adopted on November 21, 2024, the City
Commission adopted a Pilot Program, as detailed below, for Noise requirements for one (1)
year; and
WHEREAS, Ordinance No. 14330 allows the Pilot Program, which expires on November
21, 2025, to be extended by Resolution for one (1) year; and
WHEREAS, the Pilot Program specifically addresses Sections 36-4(e) and 36-5(d) of the
Code of the City of Miami, Florida ("City Code"); and the maximum sound levels as well as time
of day allowances in the NRD-1 / Wynwood Business Improvement District ("Wynwood BID")
area of the City of Miami, Florida ("City") ("Pilot Program"); and
WHEREAS, both the area business and the Wynwood BID have found the current Pilot
Program to be beneficial and wish it to continue for another year; and
WHEREAS, pursuant to Section 2-33(c)(9) of the Code of the City of Miami, Florida, as
amended ("City Code"), the City Commission may create pilot programs within the City for a
limited period of time not to exceed one (1) year with a possible extension for an additional one
(1) year period; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The Pilot Program is extended an additional one (1) year from the date of
adoption.
Section 3. This Resolution shall become effective immediately upon its adoption.
