HomeMy WebLinkAboutR-25-0487City of Miami Resolution R-25-0487 Legislation City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 18505 Final Action Date: 11/20/2025 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A ROAD JURISDICTION TRANSFER AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY AND AS GENERALLY DESCRIBED IN EXHIBIT "A," WITH THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT"), TO TRANSFER A PORTION OF NORTHEAST 6TH STREET BETWEEN STATE ROAD 5 ("SR-5") / UNITED STATES ROUTE 1 ("US-1") / BISCAYNE BOULEVARD AND NORTHEAST 2ND AVENUE, MIAMI, FLORIDA; FURTHER AUTHORIZING THE CITY MANAGER TO TAKE ANY AND ALL ACTIONS NECESSARY TO ACCOMPLISH THE SAID TRANSFER FROM THE CITY OF MIAMI ("CITY") STREET SYSTEM TO THE FDOT'S STATE HIGHWAY SYSTEM, AS STATED HEREIN; AND DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE FDOT, DISTRICT 6. SPONSOR(S): Mayor Francis X. Suarez WHEREAS, the Florida Department of Transportation ("FDOT") is in the process of analyzing the traffic management and roadway modifications necessary for the project to be located on a 2.63 acre parcel adjacent to the Freedom Tower along state, Miami -Dade County and City of Miami ("City") maintained roadways; and WHEREAS, Section 335.0415, Florida Statutes, authorizes the parties to enter into the Agreement; and WHEREAS, the City is the holder of ownership rights to Northeast 6th Street, a road not on the State Highway System; and WHEREAS, the transfer of a portion of the City's Right -of -Way to FDOT's State Highway System is necessary to accommodate the project as generally set forth in the Road Jurisdiction Transfer (RJT) Agreement, as described in Exhibit "A"; and WHEREAS, the City concurs with the proposed overall transfer of Northeast 6th Street between SR-5 / US-1/ Biscayne Boulevard and Northeast 2nd Avenue, Miami, Florida; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized to negotiate and execute a Road Jurisdiction Transfer Agreement, in a form acceptable to the City Attorney and as generally described in City of Miami Page 1 of 2 File ID: 18505 (Revision:) Printed On: 12/9/2025 File ID: 18505 Enactment Number: R-25-0487 Exhibit "A," with FDOT to accommodate the transfer of Northeast 6th Street between SR-5 / US- 1/ Biscayne Boulevard and Northeast 2nd Avenue, Miami, Florida. Section 3. The City Manager is further authorized1 to take any, and all actions necessary to accomplish said transfer from the City's Street System to FDOT's State Highway System. Section 4. The City Clerk is directed to transmit a copy of this Resolution to the FDOT, District 6. Section 5. This Resolution shall become effective immediately upon its adoption.
