RE: Resolution No. R-25-0471 — Allocate - Additional Funds - Infill Project D1

At its November 20, 2025, meeting, the City Commission adopted the above -
referenced agenda item, PH.7, authorizing the allocation of additional funds, using the
sale proceeds generated from the sales of twin home units located in District 1, in the amount
of $153,100.00 to cover the cost overruns of the development of single-family homes and/or
twin homes on certain City of Miami owned parcels of land and authorizing the City
Manager to execute any and all necessary documents, including amendments, extensions,
and modifications for said purpose. The Legislation inadvertently contained a scrivener's
error regarding the effective date.
The Legislation has been corrected and incremented to Revision A.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
ALLOCATING ADDITIONAL FUNDS, USING THE SALE PROCEEDS
GENERATED FROM THE SALES OF INFILL TWIN HOME UNITS LOCATED IN
DISTRICT 1, IN THE AMOUNT OF $153,100.00 TO COVER THE PROJECT
COST OVERRUNS, IN ORDER TO DEVELOP THE TWIN HOMES AS
SPECIFIED IN EXHIBIT "A," ATTACHED AND INCORPORATED; FURTHER
AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE ANY
AND ALL NECESSARY DOCUMENTS, INCLUDING AMENDMENTS,
RENEWALS, EXTENSIONS, AND MODIFICATION, ALL IN FORMS
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE.

WHEREAS, on April 1, 2021, the City of Miami ("City") issued a Request for Proposals
("RFP") inviting qualified private real estate developers to propose developments of single-
family homes and/or twin homes on certain City -owned parcels of land (collectively, "Project");
and
WHEREAS, on July 8, 2021, pursuant to Resolution No. R-21-0281, the City
Commission accepted the proposals received May 17, 2021, pursuant to RFP No. HCD 2021-
03, from RJ Spencer Construction LLC, a Florida Limited Liability Company, and RF
Construction Group Inc., a Florida profit corporation (collectively, "Developers"); and
WHEREAS, on March 2025, the Developers informed the City that the Project's actual
cost surpassed its original budget due to unforeseen events, specifically, economic fluctuations,
supply chain issues, and changes in labor costs; and
WHEREAS, City's Administration recommends the allocation of additional funds, using
the sale proceeds generated from the sales of twin home units located in District 1, in The
amount of $153,100.00 to cover the Project's cost overruns, as specified in Exhibit "A," atti ed 'T3
and incorporated;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OFF ' R
MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the Preamble to this Resolute a �-'
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The allocation of additional funds, using the sale proceeds generated from the
sales of twin home units located in District 1, in the amount of $153,100.00 to cover the
Project's cost overruns, as specified in Exhibit "A" attached and incorporated, is authorized.'

Section 3. The City Manager is authorized' to execute any and all necessary documents,
including amendments, extensions, and modifications, all in forms acceptable to the City
Attorney, for said purpose.
Section 4. This Resolution shall become effective immediately upon its adoption and
signature of the Mayor.2

1 The herein authorization is further subject to compliance with all legal requirements that may
be imposed, including but not limited to those prescribed by applicable City Charter and City
Code provisions.
2 If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
