Background of Item: The HOPWA Program was created under the AIDS Housing Opportunity Act and revised under the Housing and Community Development Act of 1992. Since 1994 the City of Miami ("City") has received HOPWA Program funds from the United States Department of Housing and Urban Development (" HUD") and has been responsible for the implementation of programs designed to provide housing and related services to individuals living with HIV/AIDS in the City and throughout Miami -Dade County. From Aprill , 2025, to August 31, 2025, the Department collected an amount of $10,255.29 in Housing Opportunities for Persons with Aids ("HOPWA") program income funds. The Department recommends allocating the Funds to the eligible HOPWA activities, as specified in Exhibit "A," attached and incorporated. WHEREAS, the Housing Opportunities For Persons With Aids ("HOPWA") program was created under the AIDS Housing Opportunity Act and revised under the Housing and Community Development Act of 1992; and WHEREAS, since 1994 the City of Miami ("City") has received HOPWA program funds from the United States Department of Housing and Urban Development ("HUD") and has been responsible for the implementation of programs designed to provide housing and related services to individuals living with HIV/AIDS in the City and throughout Miami -Dade County; and WHEREAS, from April 1, 2025, to August 31, 2025, the Department collected an amount of $10,255.29 in HOPWA program income funds; and WHEREAS, the Department recommends allocating the program income funds to the eligible HOPWA activities, as specified in Exhibit "A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The allocation of HOPWA program income funds in the amount of $10,255.29 from April 1, 2025, to August 31, 2025, as more particularly specified in Exhibit "A," attached and incorporated, is authorized.' Section 3. The City Manager is authorized' to negotiate and execute any and all necessary documents, including amendments, extensions, and modifications, all in forms acceptable to the City Attorney, subject to all federal, state, and local laws that regulate the use of such funds for said purpose. 1 The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions.
