Subject: Execute MOU - C-4 Basin Stormwater Operations - South Florida Water
Management
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute a Memorandum of Understanding ("MOU"), in substantially the
attached form as exhibit "A," between the South Florida Water Management District and
the City of Miami for the purpose of establishing cooperative guidelines for stormwater
pump operations and implementation of the C-4 Basin Operating Plan before, during,
and after major storm events; further authorizing the City Manager to execute any
extensions, amendments, and documents necessary to effectuate the MOU; and
providing for an effective date.
Background of Item:
The South Florida Water Management District ("DISTRICT") has adopted the C-4 Basin
Operating Plan ("Operating Plan") to minimize flooding and adverse water quantity
impacts within the C-4 Basin and downstream communities. The City of Miami ("City")
operates stormwater pump stations that discharge into the C-4 Canal pursuant to
Environmental Resource Permit Application No. 030311-10. The DISTRICT, Miami -
Dade County, City of Miami, City of West Miami, and City of Sweetwater desire to enter
into a Memorandum of Understanding ("MOU") to coordinate the operation of
stormwater pumps prior to, during, and immediately following major storm events to
reduce potential flooding impacts. The MOU, attached hereto as Exhibit "A," defines the
responsibilities of the DISTRICT and the participating local governments, including
coordination, notification, pump operation protocols, data sharing, and recordkeeping.
The C-4 Basin Operating Plan, referenced within the MOU and attached hereto as
Exhibit "B," provides the framework for stormwater management operations and
establishes conditions for stormwater pump coordination among the participating
jurisdictions. The City Commission finds that entering into this MOU and adopting the
associated Operating Plan is in the best interest of the public health, safety, and welfare
of the residents of the City of Miami.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF
UNDERSTANDING ("MOU"), IN SUBSTANTIALLY THE FORM ATTACHED AND
INCORPORATED AS EXHIBIT "A," BETWEEN THE SOUTH FLORIDA WATER
MANAGEMENT DISTRICT AND THE CITY OF MIAMI FOR THE PURPOSE OF
ESTABLISHING COOPERATIVE GUIDELINES FOR STORMWATER PUMP
OPERATIONS AND IMPLEMENTATION OF THE C-4 BASIN OPERATING PLAN
BEFORE, DURING, AND AFTER MAJOR STORM EVENTS; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE ANY EXTENSIONS,
AMENDMENTS, AND DOCUMENTS NECESSARY TO EFFECTUATE THE MOU;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the South Florida Water Management District ("District") has adopted the C-

WHEREAS, the City of Miami ("City") operates stormwater pump stations that discharge

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Commission hereby approves the Memorandum of Understanding
("MOU") between the South Florida Water Management District, Miami -Dade County, the City of
Miami, the City of West Miami, and the City of Sweetwater, in substantially the form attached
and incorporated as Exhibit "A," and the C-4 Basin Operating Plan, attached and incorporated
as Exhibit "B."
Section 3. The City Manager is authorized' to execute the MOU, in substantially the
attached form, and to execute any amendments, extensions, renewals, or related documents
necessary to implement the intent of this Resolution, in a form acceptable to the City Attorney.
Section 4. This Resolution shall become effective immediately upon its adoption.
