Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute an Off -System Construction and Maintenance Agreement, in
substantially the attached form, with the State of Florida Department of Transportation
("FDOT"), for improvements on State Road 7 / US 441 / NW 7 Avenue from south of
NW 43 Street to north of NW 45 Street, Miami, Florida, for general roadway
improvements in this corridor, including improvements on roads not on the State
Highway System.
Background of Item:
FDOT has developed design plans Financial Management ("FM") Project No. FM
250629-6-32-01 / TWO 45, for the installation of electronic speed feedback signs facing
the northbound and southbound traffic, install cabinets, pullboxes and 30 MPH speed
limit pavement marking messages on the northbound approach ("Project"). FDOT
intends to undertake and complete the Project, a portion of which includes work on
roads not on the State Highway System but City of Miami ("City") right-of-way,
specifically on NW 43 Street east of NW 7 Avenue and on NW 45 Street west of NW 7
Avenue (for purposes of this agreement, the "Off -System Project Limits"). The Project
includes the installation of conduits, conductors, pullboxes and sidewalk replacement
("Local Roadway Improvements") and all activities associated with, or arising out of the
construction of the Local Roadway Improvements. The Off -System Construction and
Maintenance Agreement, attached and incorporated as Exhibit "A", establishes the
terms, conditions, and responsibilities of FDOT and the City to accomplish the Project
and Local Roadway Improvements on the City's Streets. The City agrees with the terms
and conditions in the Agreement, in substantially the attached form. The City agrees

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN OFF -SYSTEM
CONSTRUCTION AND MAINTENANCE AGREEMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, WITH THE STATE OF FLORIDA DEPARTMENT OF
TRANSPORTATION ("FDOT"), FOR IMPROVEMENTS ON STATE ROAD 7 / UNITED
STATES ROUTE 441 ("U.S. 441") / NORTHWEST 7 AVENUE FROM SOUTH OF
NORTHWEST 43 STREET TO NORTH OF NORTHWEST 45 STREET, MIAMI,
FLORIDA, FOR GENERAL ROADWAY IMPROVEMENTS IN THE CORRIDOR,
INCLUDING IMPROVEMENTS ON ROADS NOT ON THE STATE HIGHWAY
SYSTEM.
WHEREAS, the Florida Department of Transportation ("FDOT") has developed design

install cabinets, pullboxes and thirty (30) mile per hour ("MPH") speed limit pavement marking
messages on the northbound approach ("Project"); and
WHEREAS, FDOT intends to undertake and complete the Project, a portion of which
includes work on roads not on the State Highway System but City of Miami ("City") right-of-way,
specifically on Northwest 43 Street east of Northwest 7 Avenue and on Northwest 45 Street
west of Northwest 7 Avenue (for purposes of this agreement, the "Off -System Project Limits");
and
WHEREAS, the Project includes the installation of conduits, conductors, pullboxes and
sidewalk replacement ("Local Roadway Improvements") and all activities associated with, or
arising out of the construction of the Local Roadway Improvements; and
WHEREAS, the Off -System Construction and Maintenance Agreement ("Agreement"),
attached and incorporated as Exhibit "A," establishes the terms, conditions, and responsibilities
of FDOT and the City to accomplish the Project and Local Roadway Improvements on the City's
streets; and
WHEREAS, the City agrees with the terms and conditions in the Agreement, in
substantially the attached form;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized' to execute the Agreement, in substantially
the attached form, with FDOT, for the Project on State Road ("SR") 7 / United States Route 441
("U.S. 441") / Northwest 7 Avenue from south of Northwest 43 Street to north of Northwest 45
Street, Miami, Florida, which includes improvements on roads not on the state highway system,
and the Local Roadway Improvements.
Section 3. This Resolution shall become effective immediately upon its adoption.
