Subject: Execute - Mutual Aid Agrmnt - South Florida Criminal Apprehension Team
Purpose of Item:
A Resolution of the Miami City Commission, with attachment(s), authorizing the City
Manager to execute a new Mutual Aid Agreement, in substantially the attached form,
with Palm Beach County Sheriff's Office and its participating law enforcement agencies,
to receive and extend mutual aid in the form of law enforcement services and resources
to ensure public safety and ability to adequately respond to intensive situations,
including but not limited to natural and man-made disasters or emergencies as defined
in Part 1, Chapter 23, Florida Statutes, the "Florida Mutual Aid Act."
Background of Item:
It is the intent of the Participating Law Enforcement Agencies to form the South Florida
Criminal Apprehension Team (SFCAT) to receive and extend mutual aid in the form of
law enforcement services and resources to adequately respond to continuing multi -
jurisdictional law enforcement problems, so as to protect the public peace and safety,
and preserve the lives and property of the people. The City and Palm Beach County
Sheriff's Office and its Participating Agencies have the authority under the Florida
Mutual Aid Act, Chapter 23, Part 1, Sections 23.12-23.127, Florida Statutes, to enter
mutual aid agreements. The Participating Law Enforcement Agencies have identified a
need to establish a multi -agency organization to address organized retail crime,
burglary offenses, auto theft, any felony or misdemeanor approved by the SFCAT and
related criminal activity occurring in South Florida. The City remains fully responsible for
their obligations to personnel assigned to the SFCAT for the payment of salary,
benefits, overtime and other compensation to its Officers, including any amounts paid or
due for compensation due to personal injury or death which such Officer is engaged in
rending such assistance. This Mutual Aid Agreement (MAA) shall take effect upon
execution and approval by the hereinafter, named officials and shall continue in full
force and effect for a one-year period and will be automatically renewed for consecutive
one-year periods.

A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE A MUTUAL AID AGREEMENT,
IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND
THE PALM BEACH COUNTY SHERIFF'S OFFICE AND ITS PARTICIPATING LAW
ENFORCEMENT AGENCIES, TO RECEIVE AND EXTEND MUTUAL AID IN THE
FORM OF LAW ENFORCEMENT SERVICES AND RESOURCES TO ENSURE
PUBLIC SAFETY AND ABILITY TO ADEQUATELY RESPOND TO INTENSIVE
SITUATIONS, INCLUDING BUT NOT LIMITED TO NATURAL AND MAN-MADE
DISASTERS OR EMERGENCIES AS DEFINED IN PART 1, CHAPTER 23, FLORIDA
STATUTES, TITLED "FLORIDA MUTUAL AID ACT.
WHEREAS, it is the intent of the City of Miami's ("City") Police Department ("MPD") to
participate with the Palm Beach County Sheriff's Office and various local law enforcement
agencies ("Participating Agencies") to establish the South Florida Criminal Apprehension Team
("SFCAT"); and
WHEREAS, the City and Palm Beach County Sheriff's Office and its Participating
Agencies have the authority under the Florida Mutual Aid Act, Chapter 23, Part 1, Sections
23.12-23.127, Florida Statutes, to enter mutual aid agreements to receive and extend mutual
aid in the form of law enforcement services and resources to adequately respond to continuing
multi -jurisdictional law enforcement problems, so as to protect the public peace and safety, and
preserve the lives and property of the people; and
WHEREAS, the Participating Agencies have identified a need to establish a multi -
agency organization to address organized retail crime, burglary offenses, auto theft, any felony
or misdemeanor approved by the SFCAT and related criminal activity occurring throughout
multiple jurisdictions in South Florida; and
WHEREAS, each of the Participating Agency remains responsible for their own
obligations to personnel assigned to the SFCAT for the payment of salary, benefits, overtime
and other compensation, including any amounts paid or due for compensation due to personal
injury or death which such Officer is engaged in rending such assistance; and
WHEREAS, the Mutual Aid Agreement ("MAA") for the City's participation in the SFCAT
will take effect upon approval of this resolution and shall continue in full force and effect for a
one (1) year period and will be automatically renewed for consecutive one (1) year periods;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to execute a MAA, in substantially the
attached form, with Palm Beach County Sheriff's Office and its Participating Agencies, to
receive and extend mutual aid in the form of law enforcement services and resources to the
SFCAT to ensure public safety and ability to adequately respond to intensive situations,
including but not limited to natural and man-made disasters or emergencies as defined in Part 1,
Chapter 23, Florida Statutes, the "Florida Mutual Aid Act."
Section 3. This Resolution shall become effective immediately upon its adoption.
