City of Miami File ID: 18333 (Revision:) Printed On: 12/18/2025 City of Miami Legislation Ordinance Enactment Number: 14414 File Number: 18333 Final Action Date: 11/20/2025 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 2/ARTICLE II/SECTION 2-35 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, TITLED "ADMINISTRATION/MAYOR AND CITY COMMISSION/TERMS OF ELECTED OFFICIALS AS MEMBERS OF ANY AUTHORITY, BOARD, OR COMMITTEE; ANNUAL REVIEW' TO CHANGE THE MONTH IN WHICH ELECTED OFFICIALS ARE APPOINTED TO SERVE AS A MEMBER OF ANY AUTHORITY, BOARD, OR COMMITTEE; CONTAINING A SEVERABILITY CLAUSE AND PROVIDING FOR AN IMMEDIATE EFFECTIVE DATE. WHEREAS, pursuant to Section 2-35 of the Code of the City of Miami, Florida, as amended ("City Code"), elected officials currently serving as a member of any authority, board, or committee is subject to review by the City Commission on an annual basis at the City Commission's December meeting; and WHEREAS, in 2024, the City's runoff election dates were changed to be held on the second Tuesday in December making it difficult for the City Commission to comply with Section 2-35 of the City Code; and WHEREAS, Section 2-35 of the City Code should be amended to ensure compliance with the necessary legal standards and practices; and WHEREAS, the City finds that amending the month in which elected officials are appointed to serve as members of any authority, board, or committee is in the best interests of the City and its residents; NOW THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted and incorporated as if fully set forth in this Section. Section 2. Chapter 2/Article II of the Code of the City of Miami, Florida, as amended, is amended in the following particulars:' "CHAPTER 2 ADMINISTRATION 1 Words and/or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. City of Miami File ID: 18333 (Revision:) Printed On: 12/18/2025 ARTICLE II. MAYOR AND CITY COMMISSION Sec. 2-35. Terms of elected officials as members of any authority, board, or committee; annual review. In accordance with the provisions of law and with the provisions of this section, the appointment of the mayor and/or any city commissioner currently serving as a member of any authority, board, or committee created by resolution or ordinance shall be subject to the review of the city commission on an annual basis at the commission's December first meeting in February. It is the intent of the city commission that the mayor and each commissioner be considered for appointment to an authority, board, or committee before the mayor or any one commissioner shall have served a consecutive term; however, there shall be no prohibition against the mayor or any commissioner from being reappointed to serve consecutive terms. Section 3. If any section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.2 APPROVED AS TO FORM AND CORRECTNESS: 2 This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten (10) days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein. whichever is later.
